§ A604 BROOME COUNTY CHA<strong>RT</strong>ER AND CODE § A605<br />

(D) Money received by the <strong>County</strong> but required by law to be paid to the State of New York<br />

or to the units of government within the <strong>County</strong> shall not be included in the expenditures<br />

and revenues anticipated in the budget; provided, however, that this shall not apply to<br />

moneys advanced local governmental units within the <strong>County</strong> on account of delinquent<br />

taxes.<br />

(E) Capital program. The <strong>County</strong> Executive shall review the proposed capital program as<br />

prepared by the Director of Budget and Research. He shall, after making such changes as<br />

he may deem advisable, arrange it so as to set forth clearly:<br />

(1) Each pending capital project, the amount of all liabilities outstanding, the<br />

unencumbered balances of authorization and estimated additional authorizations<br />

required for its completion.<br />

(2) Each new capital project recommended, the year in which it is recommended to be<br />

undertaken and the estimated cost.<br />

(3) Each pending or recommended project, a brief description, the estimated date of<br />

completion, the amount of liabilities estimated to be incurred in each fiscal year to<br />

completion, the estimated useful life in years, the amounts, nature and terms of<br />

obligations recommended to be authorized and the estimated annual operating and<br />

maintenance charges such project will entail.<br />

(4) Recommendations that a pending project be modified, postponed or abandoned.<br />

(5) Other information that the <strong>County</strong> Executive may deem advisable.<br />

(F)<br />

Proposed appropriation resolution. The <strong>County</strong> Executive shall prepare a proposed<br />

appropriation resolution referring to the tentative budget and making provision for the<br />

conduct of the <strong>County</strong> government for the ensuing fiscal year. The resolution shall be<br />

filed with the Clerk of the <strong>County</strong> Legislature as prescribed in Subsection (G) of this<br />

section.<br />

(G) Submission to the <strong>County</strong> Legislature. On or before the first day of October of each year,<br />

the <strong>County</strong> Executive shall submit to the Clerk of the <strong>County</strong> Legislature and make<br />

available to the public the tentative budget, including both the operation and maintenance<br />

expense budget and the capital budget, for the ensuing fiscal year, the proposed<br />

appropriation resolution as prescribed in Subsection (F) of this section and the capital<br />

program for the ensuing six fiscal years, together with an accompanying budget message<br />

as prescribed by § C604 of Article VI of the Charter. The <strong>County</strong> Legislature will<br />

proceed to consider the same and hold a public hearing and adopt a budget in a manner<br />

provided by Article VI of the Charter and the provisions of this Code. [Amended<br />

§ A605. Public hearing.<br />

Pursuant to § C606 of Article VI of the Charter, the <strong>County</strong> Legislature or a Committee<br />

designated by the <strong>County</strong> Legislature shall hold a public hearing on the tentative budget, the<br />

capital program and the budget message as submitted by the <strong>County</strong> Executive. The Clerk of<br />

the <strong>County</strong> Legislature shall cause to be printed or otherwise reproduced sufficient copies of<br />
