§ 187-4 TOWING, COMMERCIAL<br />

(5) The towing firm must supply the Sheriff with a photostatic copy of the driver's<br />

license of each employee who operates its equipment; also, any certificates of<br />

training that the operators may have.<br />

(6) The towing firm shall not tow vehicles outside of the <strong>County</strong> unless directed to by<br />

the owner or the Sheriff.<br />

(7) The towing firm shall provide a storage lot which is lighted, secured, and insured<br />

to store towed vehicles. Towers must provide access to their storage lots to the<br />

<strong>Broome</strong> <strong>County</strong> Sheriff so that officers will have the opportunity to complete their<br />

investigations. All lots will be within <strong>County</strong> limits.<br />

(8) All vehicles must have a broom and shovel as cleaning equipment for debris, and<br />

all towing firms shall be required to remove all debris related to the incident to<br />

which they are called, in accordance with New York State Vehicle and Traffic<br />

Law § 1219(c).<br />

(9) The <strong>Broome</strong> <strong>County</strong> Sheriff reserves the right to inspect applicant's equipment for<br />

the sole and exclusive purpose of ascertaining that applicant is in possession of the<br />

equipment specified and described herein, as well as other equipment which may<br />

be required.<br />

(10) Any information submitted to <strong>Broome</strong> <strong>County</strong> shall be deemed accurate. Towing<br />

firms filing permit applications represent that the towing equipment specified<br />

therein is in good working order and warrant that the same is fit for its intended<br />

purpose. The towing firm understands and acknowledges that the <strong>Broome</strong> <strong>County</strong><br />

Sheriff relies upon the towing firms' representations and warranties in issuing<br />

permits. Accordingly, by executing a permit application, and in consideration of<br />

the issuance of a permit, the towing firm agrees to defend, indemnify and save<br />

harmless <strong>Broome</strong> <strong>County</strong>, and its agents and employees, of and from any liability<br />

arising from the towing firm's breach of its representations and warranties and any<br />

liability arising from the negligence or other culpable conduct of the towing firm,<br />

its agents, or employees.<br />

(11) The <strong>Broome</strong> <strong>County</strong> Sheriff may require such additional information as may be<br />

necessary in order to enforce this chapter and to ensure the safety of all persons.<br />

§ 187-5. Penalties for offenses.<br />

A. The Sheriff may deny a permit or placement on the list to any applicant who does not<br />

comply with the provisions of this chapter or who makes a material misrepresentation on<br />

a permit application. The Sheriff shall give written notification to an applicant of the<br />

reasons for the denial, and any applicant who is denied a permit or placement on the list<br />

may, within 10 days from the date of denial, request a hearing before the Sheriff.<br />

Hearings will be conducted in the same manner as specified in Subsection B below.<br />

B. Violations of any portion of this chapter may result in suspension from the towing list<br />

following a Sheriffs investigation. Continued or severe violations may result in a<br />

permanent ban of a particular tower from the towing list. A towing firm against whom<br />
