B. Every occupant of a dwelling or dwelling unit shall dispose of his garbage and rubbish in<br />

a clean, sanitary and safe manner by placing it in the facility or containers required by<br />

this article.<br />

C. Every occupant of a dwelling unit, when required to do so by the Commissioner, shall<br />

provide rodent stoppage within the unit occupied by him.<br />

D. The occupant of any dwelling or premises other than a multiple dwelling shall supply<br />

facilities or containers for the clean, safe, sanitary storage and/or disposal of rubbish and<br />

garbage. Containers shall be animalproof, rodentproof, insectproof and watertight.<br />

E. No person shall feed in the open any domesticated or wild fowls, birds or animals other<br />

than in a suitable container and in such a manner so as to prevent scattering of food upon<br />

the ground or ground level which will or can provide food for rodents, insects, vermin or<br />

other pests.<br />

Investigations; Enforcement; Penalties<br />

§ 168-26. Right of inspections.<br />

A. All premises, places and persons affected by this Sanitary Code shall be subject to<br />

inspection or examination by the Commissioner or his authorized representative when<br />

required by this code.<br />

B. No person shall unlawfully refuse to permit any officer or employee of the Department<br />

of Health fully and freely to inspect legally any and all premises or places when such<br />

officer or employee is so authorized by the Commissioner, and no person shall molest or<br />

resist any such officer or employee of the Department of Health in the discharge of his<br />

duties.<br />

C. If the owner, occupant, agent, manager or other person in charge of the premises refuses<br />

entry to the representative of the Commissioner of Health onto the premises for the<br />

purposes of making an inspection, the Commissioner of Health or his agent may then<br />

make application for a search warrant, in a court of competent jurisdiction, to effectuate<br />

the inspection.<br />

§ 168-27. Investigations. [Amended 10-15-1985 by L.L. No. 6-1985]<br />

The Commissioner of Health, upon receiving a complaint of violation of the Public Health<br />

Law, this code or the New York State Sanitary Code, or when the probable existence of a<br />

violation comes to his attention, shall make or cause to be made by his duly authorized<br />

representative an immediate and thorough inspection and investigation for the purpose of<br />

determining whether a violation exists.<br />
