and in place of said Personnel Officer. The designation or designations shall be in writing and<br />

filed in the Department of Records, and copies thereof shall be filed with the <strong>County</strong><br />

Executive and with the Clerk of the <strong>County</strong> Legislature.<br />

A<strong>RT</strong>ICLE XVII<br />

Department of Law<br />

§ A1701. Department of Law; <strong>County</strong> Attorney; appointment; qualifications.<br />

There shall be a Department of Law headed by a <strong>County</strong> Attorney. The method of choosing<br />

the <strong>County</strong> Attorney shall be as provided in § C1701 of Article XVII of the Charter. The<br />

<strong>County</strong> Attorney shall be duly admitted to the practice of law in the State of New York and<br />

resident of the <strong>County</strong> of <strong>Broome</strong>. Throughout his term of office, the <strong>County</strong> Attorney and the<br />

Assistant and Deputy <strong>County</strong> Attorneys shall devote their whole time to the duties of their<br />

offices, shall hold no elective office and shall hold no other public office or be engaged in any<br />

employment or business or engage in professional activity with any governmental unit outside<br />

<strong>Broome</strong> <strong>County</strong> without compliance with § C2610 of the Charter. The <strong>County</strong> Attorney and<br />

the Assistant and Deputy <strong>County</strong> Attorneys shall be precluded from the private practice of law<br />

whatsoever.<br />

§ A1702. Powers and duties.<br />

The <strong>County</strong> Attorney shall be the sole legal advisor for the <strong>County</strong>, subject to any applicable<br />

rules and regulations that may be adopted by the <strong>County</strong> Legislature. He may, upon the<br />

request of the governing body of any city, town, village, school district or special district, and<br />

with the approval of the <strong>County</strong> Legislature, act as the legal advisor. He shall have and<br />

exercise all the powers and duties heretofore or hereafter lawfully granted or imposed by the<br />

Charter, this Code, local law, ordinance or resolution of the <strong>County</strong> Legislature, order or<br />

direction of the <strong>County</strong> Executive or by any applicable provision of any act of the State<br />

Legislature not inconsistent with the Charter or this Code.<br />

§ A1703. Reports.<br />

On or before March 1 of each year, the <strong>County</strong> Attorney shall make an annual report for the<br />

immediately preceding calendar year, covering generally the work of his office. He shall make<br />

such other reports at such times as may be required by the <strong>County</strong> Legislature, <strong>County</strong><br />

Executive or any other applicable law. Copies of all reports shall be filed with the Clerk of<br />

the <strong>County</strong> Legislature and the <strong>County</strong> Executive.<br />

§ A1704. Assistant and Deputy <strong>County</strong> Attorneys.<br />

The <strong>County</strong> Attorney shall appoint such Assistant and Deputy <strong>County</strong> Attorneys as shall be<br />

authorized by the <strong>County</strong> Legislature. All Assistant and Deputy <strong>County</strong> Attorneys shall serve<br />

at the pleasure of the <strong>County</strong> Attorney. The <strong>County</strong> Attorney shall designate an Assistant or<br />

Assistants to whom shall be delegated all the powers and duties of the <strong>County</strong> Attorney when<br />

such <strong>County</strong> Attorney is unable to act by reason of absence or disability. The designation or<br />
