Realty Subdivisions<br />

§ 168-6. Definitions.<br />

As used in this article, the word "subdivision" shall mean any tract of land which is hereafter<br />

divided into five or more parcels along an existing or proposed street, highway, easement or<br />

right-of-way for sale or rent as building plots, whether or not the lot or plots to be sold or<br />

offered for sale or leased for any period of time are described by metes and bounds or by<br />

reference to a map or survey of the property or by any other method of description.<br />

§ 168-7. Approval of subdivisions.<br />

Any person who shall engage in the development of a subdivision shall first submit to the<br />

Commissioner a detailed plan or plot of the subdivision, together with such other information<br />

relating to the nature of the terrain, adjacent private or public water supplies and any other<br />

pertinent information as may be required, including a statement regarding the methods<br />

proposed for providing water supply and for the disposal of sewage and other wastes. No such<br />

subdivision or portion thereof shall be sold, offered for sale, leased or rented by a corporation,<br />

company or person and no use thereof involving water supply and sewage disposal shall be<br />

undertaken thereon until a plan or plot of such subdivision shall have been filed with and<br />

approved by the Commissioner. The plan or plot shall comply with the aforesaid<br />

requirements, except that the Commissioner may in his discretion accept a less detailed plan<br />

or plot, but containing such information as he may require. If approved, the installation of<br />

such facilities shall be in accordance with the plan or plot as approved, or any approved<br />

revision or revisions thereof. If, in the judgment of the Commissioner, the proposed method of<br />

providing water supply or sewage disposal would be or might become inadequate or would<br />

endanger the public health by reason of unfavorable topography, drainage, soil, density of<br />

population or any other sanitary or physical feature, the Commissioner may refuse such<br />

approval. The determination of the Commissioner in refusing such approval shall be final. 3<br />

§ 168-8. Furnishing plans to purchasers.<br />

Owners of subdivisions offering lots for sale in a subdivision in which a public water supply<br />

and a sanitary sewer system are not provided shall furnish each purchaser at the time of sale<br />

with a legible reproduction of the approved plan or plot of the subdivision as approved by the<br />

Commissioner.<br />

§ 168-9. Commissioner's approval required for filing.<br />

The <strong>Broome</strong> <strong>County</strong> Clerk shall not record or accept for filing or recording any map, plot or<br />

plan showing a subdivision of five or more lots in any municipality unless there is endorsed<br />

thereon or annexed thereto a certificate of the Commissioner approving the water supply and<br />
