§ 102-8 BROOME COUNTY CODE § 102-9<br />

opinion, the association or corporation has failed to act expeditiously or fairly in the<br />

handling of complaints.<br />

C. To endeavor to eliminate unfair dealings or cause for complaint by conference,<br />

conciliation and persuasion.<br />

D. To request the <strong>County</strong> Executive to appoint a Hearing Officer to conduct a hearing in<br />

accordance with § 102-9 when a complaint is not resolved to the satisfaction of the<br />

Consumer Services Specialist through conciliation, conferences and persuasion.<br />

E. To conduct investigations, research, studies, surveys and analyses of matters affecting the<br />

interests of the <strong>Broome</strong> <strong>County</strong> consumer public.<br />

F. To be of assistance to all residents of the <strong>County</strong> of <strong>Broome</strong> relative to services provided<br />

by all governmental agencies in <strong>Broome</strong> <strong>County</strong>.<br />

G. To undertake special activities to inform welfare recipients, the elderly, those persons not<br />

fluent in either written or spoken English and other groups of people who operate at a<br />

disadvantage in the marketplace. In addition to the use of mass media communications<br />

for this purpose, simplified versions of the Consumer Code shall be posted in agencies<br />

that service these groups of people.<br />

H. To undertake activities to encourage local business, industry and government to maintain<br />

high standards of honesty, fair business practices and public responsibility in the<br />

production, promotion and sale of consumer goods and services.<br />

I. To initiate his or her own investigation of frauds or unfair dealings against consumers.<br />

J. To represent consumer interests before legislative, regulatory and administrative bodies.<br />

K. To cooperate with other agencies, public and private, in the development of standards<br />

and quality grades for consumer goods and services.<br />

L. To receive, administer, pay over and distribute moneys collected in and as a result of<br />

actions brought for violations of this chapter.<br />

M. To report to the appropriate law enforcement agencies any information concerning<br />

possible violations of a penal nature of any consumer protection law.<br />

N. To secure from the court those subpoenas requiring court approval under § 2302 of the<br />

Civil Practice Law and Rules. All such applications and all other subpoenas shall receive<br />

the prior approval of the <strong>County</strong> Attorney.<br />

O. To exercise and perform such other functions, powers and duties as may be deemed<br />

necessary or appropriate to carry out the purposes of this Consumer Code.<br />

§ 102-9. Hearings.<br />

A. Filing of complaint. All complaints must be in writing, signed by the complainant, on a<br />

form to be prescribed by the Consumer Services Specialist. Complaints may be filed at<br />
