Public Defender<br />

§ A2201. Public Defender; appointment; qualifications.<br />

There shall be a Public Defender's Office headed by a Public Defender. The method of<br />

choosing the Public Defender shall be as provided in § C2201 of Article XXII of the Charter.<br />

He shall be duly admitted to the practice of law in the State of New York.<br />

Throughout his term of office, the Public Defender and his Assistants shall devote their whole<br />

time to the duties of their office, shall hold no elective office and shall hold no other public<br />

office or be engaged in any employment, business or professional activity with any<br />

government unit without compliance with § C2610 of the Charter. The Public Defender and<br />

the Assistant Public Defenders shall be precluded from the private practice of law whatsoever.<br />

§ A2202. Powers and duties.<br />

The Public Defender shall have and exercise all the powers and duties heretofore or hereafter<br />

lawfully granted or imposed by the Charter, this Code, local law, ordinance or resolution of<br />

the <strong>County</strong> Legislature, order or direction of the <strong>County</strong> Executive or by any applicable<br />

provision of any act of the State Legislature not inconsistent with the Charter or this Code.<br />

§ A2203. Reports.<br />

On or before October 1 in each year, the Public Defender shall make an annual report for the<br />

immediately preceding period of July 1 to June 30, covering generally the work of his Office.<br />

The Public Defender shall make such other reports at such times as may be required by the<br />

<strong>County</strong> Legislature, <strong>County</strong> Executive or any other applicable law. Copies of all reports shall<br />

be filed with the Clerk of the <strong>County</strong> Legislature and the <strong>County</strong> Executive.<br />

§ A2204. Assistant Public Defenders.<br />

The Public Defender shall appoint such Assistant Public Defenders as shall be authorized by<br />

the <strong>County</strong> Legislature. All Assistant Public Defenders shall serve at the pleasure of the<br />

Public Defender. The Public Defender shall designate an Assistant or Assistants to whom<br />

shall be delegated all the powers and duties of the Public Defender when such Public<br />

Defender is unable to act by reason of absence or disability. The designation or designations<br />

shall be in writing and filed in the Department of Records, and copies thereof shall be filed<br />

with the <strong>County</strong> Executive and with the Clerk of the <strong>County</strong> Legislature.<br />

The Assistant Public Defenders shall, in case of vacancy in the office of Public Defender,<br />

perform the duties of the Public Defender until a successor is elected or appointed and has<br />

qualified.<br />
