Sheriff<br />

§ C2301. Sheriff; election; term; qualifications. [Amended 9-27-1976 by L.L. No.<br />

5-1976]<br />

There shall be an Office of Sheriff headed by a Sheriff. The election of the Sheriff, together<br />

with his term of office, shall be as provided in Article XIII of the New York State<br />

Constitution. At the time of his election and throughout his term of office, he shall be a<br />

qualified elector of the <strong>County</strong>.<br />

Throughout his term of office, the Sheriff shall devote his whole time to the duties of his<br />

office and shall hold no other elective office; and the Undersheriff, throughout his term of<br />

office, shall devote his whole time to the duties of his office and shall hold no elective office;<br />

and neither shall hold any other public office or be engaged in any employment, public or<br />

professional activity with any governmental unit without compliance with § C2610 of the<br />

Charter.<br />

§ C2302. Powers and duties. [Amended 9-27-1976 by L.L. No. 5-1976]<br />

The Sheriff shall have and exercise all the powers and duties heretofore or hereafter lawfully<br />

granted or imposed by the Charter, Code, local law, ordinance or resolution of the <strong>County</strong><br />

Legislature or order or direction of the <strong>County</strong> Executive not inconsistent with those powers<br />

and duties under the New York State Constitution vesting in said office.<br />

§ C2303. Deputies. [Amended 6-19-1973 by L.L. No. 3-1973; 5-4-1976 by L.L. No.<br />

2-1976; 10-17-1988 by L.L. No. 7-1988]<br />

(A) The Sheriff shall have the power to appoint such deputies as may be authorized by the<br />

<strong>County</strong> Legislature, subject to the provisions of this section. All deputies above the rank<br />

of Sergeant shall serve at the pleasure of the Sheriff, subject to the provisions of this<br />

section. All promotions to the rank of Major shall be made from and with personnel<br />

holding the grade or rank of Captain, Lieutenant or Sergeant at the time of such<br />

appointment. All promotions to the rank of Captain shall be made from and with the<br />

personnel holding the grade or rank of Lieutenant or Sergeant at the time of such<br />

appointment, and all promotions to the rank of Lieutenant shall be made from and with<br />

the personnel holding the grade or rank of Sergeant at the time of such appointment.<br />

(B) All deputies of the Sheriff of the rank or grade of Sergeant, excluding civil deputies of<br />

such ranks or grades, commencing one (1) year prior to the first competitive examination<br />

for Deputy Sheriffs of the rank and grade of Sergeant and below the rank and grade of<br />

Sergeant, excluding civil deputies of such ranks or grades, are hereby placed in the<br />

competitive classified service of the civil service and shall be hired by competitive<br />

examinations under the provisions of the Civil Service Law of the State of New York,<br />

and such deputies of the ranks or grades of Sergeant and below shall be subject to and<br />

governed and controlled by the rules and regulations of the New York State Department<br />

of Civil Service and the <strong>Broome</strong> <strong>County</strong> Department of Personnel.<br />
