§ C2604 BROOME COUNTY CHA<strong>RT</strong>ER AND CODE § C2607<br />

heads of departments. The following positions in the classified service shall be included in the<br />

exempt class: (1) deputies who are authorized to act generally for and on behalf of their<br />

principals; (2) the confidential secretary to any officer or department head; (3) calendar clerk;<br />

(4) Personnel Officer; (5) Assistant District Attorney; (6) Assistant <strong>County</strong> Attorneys; (7)<br />

Assistant Public Defenders; and (8) contractors and their employees engaged to perform<br />

specified services.<br />

§ C2605. Filling vacancy in elective office of <strong>County</strong> Executive.<br />

A vacancy occurring otherwise than by expiration of term or by creation upon passage of this<br />

Charter in the office of <strong>County</strong> Executive shall be filled by appointment by the <strong>County</strong><br />

Legislature of a qualified elector of the <strong>County</strong> having the same political affiliation as the<br />

person last elected to that office. The term of such person so appointed shall be until the<br />

commencement of the calendar year next succeeding the first general election after the<br />

happening of the vacancy if the vacancy occurs before September 20 of any year. If the<br />

vacancy occurs after September 20 of any year, then the term of such person so appointed<br />

shall be until the commencement of the second calendar year next succeeding the first general<br />

election after the happening of the vacancy, at which election a <strong>County</strong> Executive may be<br />

elected for the balance of the unexpired term, if any.<br />

§ C2606. Filling vacancy in elective office of District Attorney, Sheriff and <strong>County</strong><br />

Clerk.<br />

A vacancy occurring otherwise than by expiration of term in any elective <strong>County</strong> office,<br />

including but not limited to the offices of District Attorney, Sheriff and <strong>County</strong> Clerk, shall be<br />

filled by appointment by the <strong>County</strong> Executive, subject to confirmation by the <strong>County</strong><br />

Legislature, of a qualified elector of the <strong>County</strong> having the same political affiliation as the<br />

person last elected to that office. The term of such person so appointed shall be until the<br />

commencement of the calendar year next succeeding the first general election after the<br />

happening of the vacancy if the vacancy occurs before September 20 of any year. If the<br />

vacancy occurs after September 20 of any year, then the term of such person so appointed<br />

shall be until the commencement of the second calendar year next succeeding the first general<br />

election after the happening of the vacancy, at which election a District Attorney, Sheriff and<br />

<strong>County</strong> Clerk, as the case may be, shall be elected for the balance of the term, if any.<br />

§ C2607. Filling other vacancies.<br />

Except as otherwise provided in this Charter, a vacancy in the office of the head of any<br />

administrative unit the head of which by virtue of this Charter the <strong>County</strong> Executive or the<br />

<strong>County</strong> Legislature shall have the power to appoint or remove shall be filled by a person who<br />

shall be appointed on the basis of his administrative experience and his qualifications for the<br />

duties of such office by the <strong>County</strong> Executive, subject to confirmation by the <strong>County</strong><br />

Legislature. Except as otherwise provided in this Charter, the head of any administrative unit<br />

shall have the power to fill vacancies occurring within such administrative unit pursuant to the<br />

Civil Service Law.<br />
