§ A2302-A BROOME COUNTY ADMINISTRATIVE CODE § A2302-A<br />

acquired shall vest in such Board of Trustees in its own name, and such property shall be<br />

held and used by such Board for college purposes. Title to real property so acquired shall<br />

vest in and be held by the local sponsor in trust for the uses and purposes of the college.<br />

2. The Board shall have the power to sell or lease personal property held in trust by the<br />

Board which is surplus, obsolete or otherwise no longer needed for college purposes.<br />

3. The Board of Trustees shall have the authority to authorize the Treasurer to establish and<br />

maintain petty cash funds, not in excess of $200 each, for specified college purposes or<br />

undertakings from which may be paid, in advance of audit, properly itemized and<br />

verified or certified bills for materials, supplies or services furnished to the college for<br />

the conduct of its affairs and upon terms calling for the payment of cash to the vendor<br />

upon delivery of any such materials or supplies or rendering of such services. A list of all<br />

expenditures made from such petty cash funds shall be presented to the Trustees at each<br />

regular meeting thereof, together with the bills supporting such expenditure, for audit,<br />

and the Board shall direct the reimbursement of such petty cash funds from the<br />

appropriate budgetary item or items in an amount equal to the total of such bills which<br />

the Board shall so audit and allow.<br />

Any such bills or any portion of any such bills as shall be disallowed upon audit shall<br />

be the personal responsibility of the Treasurer, and such Treasurer shall forthwith<br />

reimburse such petty cash fund in the amount of such disallowances.<br />

The Treasurer shall file a report with the <strong>County</strong> Commissioner of Finance and the<br />

Comptroller, detailing the expenditures in each petty cash fund, within 10 days of the<br />

Board meeting where such expenditures were presented for audit and allowance.<br />

4. The Board shall specifically have the power to contract with other public corporations as<br />

defined in the General Corporation Law or with other public authorities, including but<br />

not limited to the federal government, for purposes of participation in federal student<br />

loan programs; provided, however, that the <strong>County</strong> shall not be liable for any portion of<br />

any defaults which the Board has agreed to assume pursuant to any such agreement.<br />

5. The Board is not authorized to contract for general attorneys' services or insurance<br />

without the approval of the <strong>County</strong>; provided, however, that in the event of a conflict of<br />

interest between the <strong>County</strong> and the college where such conflict is proclaimed by a<br />

majority vote of the Board of Trustees, said Board shall be authorized to employ separate<br />

counsel to represent it at its own expense.<br />

6. The Board shall have the power to appoint a Treasurer, establish a bank account or<br />

accounts in the name of the college and deposit therein moneys received or collected by<br />

the college, including moneys appropriated and paid by the local sponsor, moneys<br />

received from tuition, fees, charges, sales of products and services and from all other<br />

sources. The Board shall have the authority to adopt investment policies which are<br />

consistent with the restrictions on investments imposed by the New York State<br />

Comptroller and other applicable laws.<br />

7. The Board shall have the power to pay salaries and wages.<br />
