§ 203-4 BROOME COUNTY CODE § 203-6<br />

B. For those architectural and engineering service contracts for which legislative<br />

authorization is required by the <strong>Broome</strong> <strong>County</strong> Charter and for which the appropriate<br />

Commissioner expects the compensation to be $15,000 or less, the appropriate<br />

Commissioner shall conduct negotiations on scope of work and professional<br />

compensation initially with the highest ranked architectural or engineering firm. The<br />

Commissioner shall advise all Legislators of the time and place of said negotiating<br />

sessions and shall allow all Legislators to observe said sessions. If a mutually satisfactory<br />

contract cannot be negotiated with that firm, the Commissioner shall formally terminate<br />

the negotiations and notify the firm. Negotiations then shall be initiated with the<br />

second-ranked firm, and this procedure shall be continued until a mutually satisfactory<br />

contract has been negotiated. if negotiations fail with the listed firms, the names of<br />

additional firms shall be selected and ranked by the appropriate Commissioner, and<br />

negotiations shall continue in the manner described above.<br />

§ 203-5. Public reports.<br />

Upon reaching agreement on the terms of a contract with a firm, the appropriate<br />

Commissioner shall refer the proposal to the <strong>Broome</strong> <strong>County</strong> Legislature for approval. The<br />

Commissioners shall issue an annual report summarizing the projects processed during the<br />

year and the architects and engineers selected to design them.<br />

§ 203-6. Administrative provisions.<br />

A. Nothing in this chapter shall affect the validity or effect of any contracts in existence at<br />

the effective date hereof.<br />

B. This chapter shall not apply to architectural and engineering service contracts for which<br />

legislative authorization is not required by the <strong>Broome</strong> <strong>County</strong> Charter.<br />

C. If any section, subsection, paragraph, phrase, clause or word of this chapter is held to be<br />

invalid, the remainder of the chapter shall not be affected.<br />
