§ A302 BROOME COUNTY ADMINISTRATIVE CODE § A305<br />

(R) Refund taxes erroneously assessed on the tax roll of any town, upon the affidavit of the<br />

Assessor or assessors and with the consent of the Supervisor of the particular town.<br />

(S)<br />

Direct the cancellation of unpaid taxes levied by the <strong>County</strong> Legislature against property<br />

of the State of New York where it is determined that a lien on such tax cannot be<br />

enforced; and to direct the refunding of taxes paid upon property owned by the State of<br />

New York and upon the affidavit of the Assessor or assessors and with the consent of the<br />

Supervisor of the particular town.<br />

(T) Settle claims for or against the <strong>County</strong> not exceeding $1,500. A written report shall be<br />

filed with the <strong>County</strong> Legislature within 30 days after the settlement of any claim. 5<br />

§ A303. Removal.<br />

The <strong>County</strong> Executive may be removed by the Governor in the manner provided in the Public<br />

Officers Law for the removal of <strong>County</strong> officers.<br />

§ A304. Deputy <strong>County</strong> Executives and Acting <strong>County</strong> Executive. [Amended 10-4-1983<br />

by L.L. No. 4-1983]<br />

The acts performed by the Deputy <strong>County</strong> Executives, if appointed, and/or Acting <strong>County</strong><br />

Executive, pursuant to §§ C304 and C306 of Article III of the Charter, shall have the same<br />

force and effect as if performed by the <strong>County</strong> Executive. Pursuant to §§ C304 and C306 of<br />

Article III of the Charter, the Deputy <strong>County</strong> Executives and/or Acting <strong>County</strong> Executive<br />

shall have and exercise all the powers of the <strong>County</strong> Executive except the power of removal<br />

as provided in § A309 of this Code.<br />

§ A305. Division of Budget and Research.<br />

(A) The Division of Budget and Research shall be headed by a Director. The qualifications<br />

of the Director of Budget and Research shall include:<br />

(1) Graduation with a bachelor's degree from an accredited college having a four-year<br />

program, with major work in accounting, together with four years of experience in<br />

the accounting field, two of which preferably with a municipality;<br />

(2) Graduation from a standard senior high school, together with eight years of<br />

experience in the accounting field, two of which preferably with a municipality; or<br />

(3) Any equivalent combination of experience and training indicating ability to do the<br />

work.<br />

(B) The Director of Budget and Research shall:<br />
