Department of Finance<br />

§ A501. Department of Finance; Commissioner; appointment; qualifications.<br />

The Department of Finance shall be headed by a Commissioner. The method of choosing a<br />

Commissioner shall be as provided in § C501 of Article V of the Charter. The qualifications<br />

of the Commissioner shall be as follows: he shall be graduated from an approved four-year<br />

college course with a business-related degree or major, or graduated from high school with six<br />

years of experience in a managerial position in business or government dealing with the<br />

control of substantial sums of money, or the equivalent of any combination of experience and<br />

training.<br />

§ A502. Powers and duties of Commissioner of Finance.<br />

(A) The Commissioner of Finance shall have all the powers and duties and shall be subject to<br />

all the obligations and liabilities heretofore or hereafter lawfully granted or imposed by<br />

the Charter, this Code, local law, ordinance or resolution of the <strong>County</strong> Legislature, order<br />

or direction of the <strong>County</strong> Executive or any applicable provision of any act of the State<br />

Legislature not inconsistent with the Charter or this Code. Such powers, duties,<br />

obligations and liabilities shall include, but shall not be limited to, any power, duty,<br />

obligation or liability now or hereafter required by any law to be performed by or<br />

imposed upon a <strong>County</strong> Treasurer, the chief fiscal officer of a <strong>County</strong> or other <strong>County</strong><br />

officer in relation to the collection of taxes.<br />

(B) The Commissioner of Finance shall:<br />

(1) Have custody of all surety bonds and such other instruments and contracts as the<br />

<strong>County</strong> Executive may direct to remain on file in his office as a public record.<br />

(2) Make and file with the Comptroller, daily, statements of all funds and moneys<br />

received and disbursed, of whatever name or nature, in such form as the<br />

Comptroller shall direct.<br />

(3) Have charge of the collection, receipt, custody, deposit, investment and<br />

disbursement of all fees, taxes, revenues and other funds of the <strong>County</strong> or for<br />

which the <strong>County</strong> is responsible.<br />

(4) Perform such other related duties as the <strong>County</strong> Executive or the <strong>County</strong><br />

Legislature may prescribe.<br />

§ A503. Statement of financial condition.<br />

(A) In addition to the annual report required by § C502(C) of Article V of the Charter, the<br />

Commissioner of Finance shall, and at such other times as the <strong>County</strong> Executive or the<br />

<strong>County</strong> Legislature may by resolution direct, submit to the <strong>County</strong> Executive, the<br />

Comptroller and the <strong>County</strong> Legislature a statement of the financial condition of the<br />

<strong>County</strong>.<br />
