Department of Health<br />

§ A701. <strong>County</strong> Health District and Department of Health; Commissioner or Director;<br />

appointment; qualifications.<br />

The <strong>County</strong> shall continue to be a <strong>County</strong> Health District. There shall be a Department of<br />

Health headed by a Commissioner or a Director. The method of choosing the Commissioner<br />

or the Director, as well as his qualifications, shall be provided in § C701 of Article VII of the<br />

Charter.<br />

§ A702. Powers and duties.<br />

The Commissioner or Director of Health shall have all the powers and perform all the duties<br />

conferred or imposed upon <strong>County</strong> or Part-<strong>County</strong> Health Commissioners and/or <strong>County</strong> or<br />

Part-<strong>County</strong> Boards of Health by law, except as may otherwise be provided by the Charter<br />

and this Code. He shall have and exercise all the powers and duties and shall be subject to all<br />

the obligations and liabilities heretofore or hereafter lawfully granted or imposed by the<br />

Charter, Code, local law, ordinance or resolution of the <strong>County</strong> Legislature, order or direction<br />

of the <strong>County</strong> Executive or any applicable provision of any act of the State Legislature not<br />

inconsistent with the Charter and Code. In addition thereto, he shall perform such other and<br />

related duties as shall be required or delegated to him by the <strong>County</strong> Executive or <strong>County</strong><br />

Legislature. On or before March 1 in each year, the Commissioner or Director of Health shall<br />

make an annual report for the immediately preceding calendar year covering generally the<br />

work of his Department. The Commissioner or Director shall make such other reports at such<br />

times as may be required by the <strong>County</strong> Legislature, <strong>County</strong> Executive, New York State<br />

Department of Health or any other applicable law. Copies of all reports shall be filed with the<br />

Clerk of the <strong>County</strong> Legislature and the <strong>County</strong> Executive.<br />

§ A703. Health Advisory Board.<br />

There shall be a Health Advisory Board, consisting of the Chairman of the <strong>County</strong><br />

Legislature, the Chairman of the Public Health Committee of the <strong>County</strong> Legislature and nine<br />

other members, all of whom shall be residents of <strong>Broome</strong> <strong>County</strong>, and three of whom shall be<br />

physicians duly licensed to practice in the State of New York. The <strong>Broome</strong> <strong>County</strong> Medical<br />

Society may submit to the <strong>County</strong> Executive a list of physicians from which the <strong>County</strong><br />

Executive may choose the physician members of the Health Advisory Board.<br />

Except for the Chairman of the <strong>County</strong> Legislature and the Chairman of the Public Health<br />

Committee, members of the Health Advisory Board shall be appointed by the <strong>County</strong><br />

Executive and subject to confirmation by the <strong>County</strong> Legislature for a term of four years,<br />

except that of those first appointed, three for two-year terms; three for three-year terms and<br />

three for four-year terms. If the <strong>County</strong> Executive fails to fill a vacancy on the Health<br />

Advisory Board within 60 days after a vacancy occurs, the <strong>County</strong> Legislature shall proceed<br />

to fill such vacancy in the same manner as provided herein. Whenever a vacancy occurs by<br />

expiration of term, a member may continue his office for a period not to exceed 60 days<br />

unless an appointment is made thereto.<br />
