§ 19-21. Rules for proceedings and appeals.<br />

The Board shall be deemed to be an agency within the meaning of Article 3 of the State<br />

Administrative Procedure Act and shall adopt rules governing the conduct of adjudicatory<br />

proceedings and appeals taken pursuant to a proceeding commenced under Article 78 of the<br />

Civil Practice Law and Rules of the State of New York relating to the assessment of the civil<br />

penalties herein authorized and Board denials of requests for certain deletions or exemptions<br />

to be made from a financial disclosure statement as authorized in § 19-16G or H hereof. Such<br />

rules, which shall not be subject to the approval requirements of the State Administrative<br />

Procedure Act, shall provide for due process procedural mechanisms substantially similar to<br />

those set forth in such Article 3, but such mechanisms need not be identical in terms or scope.<br />

Assessment of a civil penalty or Board denial of such a request shall be final, unless modified,<br />

suspended or vacated within 30 days of imposition, with respect to the assessment of such<br />

penalty, or unless such denial of request is reversed within such time period and, upon<br />

becoming final, shall be subject to review at the insistence of the affected reporting<br />

individuals in a proceeding commenced against the Board pursuant to Article 78 of the Civil<br />

Practice Law and Rules of the State of New York.<br />

§ 19-22. Filing of notices.<br />

A copy of any notice of delinquency or notice of violation sent pursuant to § 19-18 or 19-19<br />

hereof shall be included in the reporting person's file and be available for public inspection.<br />

§ 19-23. Additional powers and duties.<br />

In addition to any other powers and duties specified by law, the Board shall have the power<br />

and duty to:<br />

A. Administer and enforce all the provisions of §§ 19-16 through 19-22.<br />

B. Administer and enforce all the provisions of § 19-4 and §§ 19-25 through 19-32.<br />

C. Conduct any investigation necessary to carry out the provisions of § 19-4, §§ 19-16<br />

through 19-22 and §§ 19-25 through 19-32. Pursuant to this power and duty, the Board<br />

may administer oaths or affirmations, subpoena witnesses, compel their attendance and<br />

require the production of any books or records which it may deem relevant or material.<br />

§ 19-24. Records available for public inspection.<br />

A. The records of the Board which shall be available for public inspection for a period of<br />

seven years are:<br />

(1) The information set forth in an annual statement of financial disclosure filed<br />

pursuant to the Code of Ethics, except any of the categories of value or amount,<br />

which shall remain confidential, and any item of information deleted pursuant to<br />

§ 19-16G hereof.<br />

(2) The information set forth in the gift disclosure statement filed pursuant to § 19-4.<br />
