§ 115-3 DOGS AND OTHER ANIMALS<br />

§ 115-3. Adoption.<br />

Dogs which would otherwise be euthanized shall be made available for adoption by animal<br />

welfare organizations upon the following terms and conditions:<br />

A. The number of dogs adopted in this manner shall not exceed 5% of the total number of<br />

dogs adopted during any calendar year.<br />

B. Adoption by animal welfare organizations in this manner shall be understood to be for<br />

the purpose of subsequent adoption as a private transaction.<br />

C. The adopting organization shall not sell the adopted dog or profit in any manner by<br />

ownership gained at the reduced fee.<br />

D. The adopting organization will license the adopted dog at the established fee.<br />

E. The adopting organization accepts all risks associated with the ownership of the dog and<br />

understands that <strong>Broome</strong> <strong>County</strong> makes no guaranties concerning the condition of the<br />

dog, and further disclaims any liability related to the dog subsequent to adoption.<br />

F. The adopting organization will not return the adopted dog to the <strong>Broome</strong> <strong>County</strong> Dog<br />

Shelter under any circumstances.<br />

G. The Director of Security or his designee shall have final authority relative to adoptions at<br />

the reduced fee and may discontinue making such adoptions completely if, in his<br />

judgment, abuses are evident or suspected, or if such adoptions appear to have an adverse<br />

impact on the level of regular adoptions by the public. [Amended 10-16-2008 by L.L.<br />

Rabies Vaccinations<br />

[Adopted 7-23-1985 by L.L. No. 3-1985]<br />

§ 115-4. Purpose.<br />

The purpose of this Article is to require compulsory antirabies vaccination of all dogs in<br />

<strong>Broome</strong> <strong>County</strong>.<br />

§ 115-5. Vaccination to be compulsory.<br />

In accordance with § 2145 of the Public Health Law of the State of New York and the<br />

determination of the New York State Commissioner of Health that rabies exists in <strong>Broome</strong><br />

<strong>County</strong>, it is hereby declared that the health and welfare of the people of the <strong>County</strong> of<br />

<strong>Broome</strong> requires compulsory antirabies vaccination of all dogs in <strong>Broome</strong> <strong>County</strong> which are<br />

six months of age or older.<br />
