§ 115-1 BROOME COUNTY CHARTER AND CODE § 115-2 (1) Forty dollars for the first 24 hours or part thereof and $5 for each additional 24 hours or part thereof and $10 for each additional 24 hours or part thereof beginning the fourth consecutive day. (2) Fifty dollars for the first 24 hours or part thereof and $5 for each additional 24 hours or part thereof for the second impoundment and $10 for each additional 24 hours or part thereof beginning the fourth consecutive day, within one year of the first impoundment, of any dog owned by that person. (3) Sixty dollars for the first 24 hours or part thereof and $5 for each additional 24 hours or part thereof for the third and subsequent impoundment, within one year of the first impoundment, and $10 for each additional 24 hours or part thereof beginning the fourth consecutive day, of any dog owned by that person. C. The owner or harborer of an impounded animal must pay impoundment, boarding, $40 vaccination fee and other costs due, even if he or she does not redeem the animal. D. Emergency boarding of dogs brought to the shelter because the owner(s) is unable to care for the dog as the result of an emergency such as an accident involving the owner, owner's illness or hospitalization, arrest of the owner, or disaster: $20 per day per dog, and $17 per day per dog for multiple dogs for a maximum of 30 days, provided that neither the owner nor the dog are in violation of any state or local law or regulation pertaining to pets and animals. E. The owner of a dog boarding under the emergency boarding provisions of Subsection D above shall be responsible for all other costs or charges incurred while boarding the dog, including veterinary care to protect or maintain the health of the animal or to treat any illness or injury of the animal. F. The fee for prearranged boarding will be $20 per day per dog, and $17 per day per dog for multiple dogs and an additional $2 per day per dog for food if not provided by the owner(s). If requested by the owner for prearranged private boarding, there will be a charge of $15 for a bath. G. Failure to pay any shelter fee is a violation of this article. H. Any collection made by the Broome County Security Division for past-due balances shall incur a finance charge of $20 in addition to the outstanding balance. I. All fees and costs will escalate at 5% per year rounded to the nearest dollar. § 115-2. Accepting unwanted dog. [Amended 12-21-2006 by L.L. No. 1-2007] An owner(s) residing outside of Broome County shall pay a fee of $30 per dog upon surrendering ownership of said dog to the shelter; an owner(s) who adopted a dog from another animal shelter shall pay a fee of $30 per dog upon surrendering ownership of said dog to the shelter; an owner(s) requesting euthanasia of his or her dog shall pay a fee of $40 per dog upon surrendering ownership of said dog to the shelter. 115:2 06 - 01 - 2009
§ 115-3 DOGS AND OTHER ANIMALS § 115-5 § 115-3. Adoption. Dogs which would otherwise be euthanized shall be made available for adoption by animal welfare organizations upon the following terms and conditions: A. The number of dogs adopted in this manner shall not exceed 5% of the total number of dogs adopted during any calendar year. B. Adoption by animal welfare organizations in this manner shall be understood to be for the purpose of subsequent adoption as a private transaction. C. The adopting organization shall not sell the adopted dog or profit in any manner by ownership gained at the reduced fee. D. The adopting organization will license the adopted dog at the established fee. E. The adopting organization accepts all risks associated with the ownership of the dog and understands that Broome County makes no guaranties concerning the condition of the dog, and further disclaims any liability related to the dog subsequent to adoption. F. The adopting organization will not return the adopted dog to the Broome County Dog Shelter under any circumstances. G. The Director of Security or his designee shall have final authority relative to adoptions at the reduced fee and may discontinue making such adoptions completely if, in his judgment, abuses are evident or suspected, or if such adoptions appear to have an adverse impact on the level of regular adoptions by the public. [Amended 10-16-2008 by L.L. No. 8-2008] ARTICLE II Rabies Vaccinations [Adopted 7-23-1985 by L.L. No. 3-1985] § 115-4. Purpose. The purpose of this Article is to require compulsory antirabies vaccination of all dogs in Broome County. § 115-5. Vaccination to be compulsory. In accordance with § 2145 of the Public Health Law of the State of New York and the determination of the New York State Commissioner of Health that rabies exists in Broome County, it is hereby declared that the health and welfare of the people of the County of Broome requires compulsory antirabies vaccination of all dogs in Broome County which are six months of age or older. 115:3 06 - 01 - 2009
