§ A309 BROOME COUNTY ADMINISTRATIVE CODE § A309<br />

by the <strong>County</strong> Legislature, except for the Division of Budget and Research, Division of<br />

Solid Waste Management, and Director of Purchasing. The <strong>County</strong> Executive may<br />

appoint one head for two or more departments or other administrative units, subject to<br />

any and all requirements as to qualifications and confirmation, or may himself or herself<br />

so serve without such confirmation all without substantial salary for so serving.<br />

(B) Appointments.<br />

(1) Each appointment by the <strong>County</strong> Executive shall be in writing, signed by the<br />

<strong>County</strong> Executive and filed in the office of the Clerk of the <strong>County</strong> Legislature and<br />

Department of Records within 10 days after the date of the appointment. No<br />

appointee shall hold office beyond the term of the <strong>County</strong> Executive by whom the<br />

appointment was made, except that unless removed, he shall continue to serve until<br />

his successor is appointed and has qualified or until an interim appointment is<br />

made, unless otherwise provided in the Charter.<br />

(2) Upon confirmation by the <strong>County</strong> Legislature and qualifying for the office, an<br />

appointee to the position of head of an administrative unit shall enter upon the<br />

duties thereof.<br />

(3) In the event that the <strong>County</strong> Legislature has neither confirmed nor rejected an<br />

appointment made by the <strong>County</strong> Executive pursuant to the Charter by the next<br />

regular meeting occurring more than 15 days after the filing of appointment with<br />

the Clerk of the <strong>County</strong> Legislature, such appointment shall be deemed to be<br />

confirmed.<br />

(4) Awaiting action by the <strong>County</strong> Legislature, the <strong>County</strong> Executive may designate a<br />

qualified person to serve as such head.<br />

(5) Prior to the designation by the <strong>County</strong> Executive of the head of an administrative<br />

unit, the <strong>County</strong> Executive may designate an acting head of said unit for a period<br />

not to exceed six months, unless extended by the Legislature. In the event that<br />

such appointee was not a <strong>County</strong> employee immediately prior to the acting<br />

appointment, the appointee shall receive the minimum of the grade for the<br />

position; and in the event that the acting appointee was an employee of the <strong>County</strong><br />

immediately prior to the acting appointment, the appointee shall receive the<br />

minimum of the grade for the new position or five and one-half percent (5 1/2%)<br />

of the minimum of the new grade added to the present salary of the appointee,<br />

(6) All other officers and employees of each administrative unit shall be appointed by<br />

the head thereof unless provided by the Charter or Code.<br />

(C) If the Charter or Code prescribes specific qualifications for an appointment made by the<br />

<strong>County</strong> Executive, pursuant to § C311 of Article III of the Charter, the written notice of<br />

such appointment required by § C311 shall also contain a statement of the qualifications<br />
