§ A208 BROOME COUNTY CHA<strong>RT</strong>ER AND CODE § A212<br />

may change, supersede or amend any act of the New York State Legislature. Such power shall<br />

include but shall not be limited to a power or powers vested in any <strong>County</strong> in the State of<br />

New York or the elective governing body thereof to adopt, amend or repeal local laws granted<br />

by any provisions of general laws, special laws, charters, special acts or local laws. The<br />

provisions of the Municipal Home Rule Law are hereby made applicable for the adoption and<br />

publication subsequent thereto of all local laws.<br />

§ A209. Form and procedure. [Amended 6-24-1986 by L.L. No. 5-1986; 4-4-1991 by<br />

L.L. No. 10-1991]<br />

Every local law shall be entitled "Local Law No. _____, Year _____ ..." (amending, etc. or<br />

otherwise as the case may be). If a local law amends a specific local law, the matter to be<br />

eliminated shall be enclosed in brackets or parentheses and the new matter underscored or<br />

italicized.<br />

Except as may otherwise be provided in the Charter, the procedure for the adoption of a local<br />

law, including referendum, mandatory or permissive, shall be as provided in Articles 3 and 4<br />

of the Municipal Home Rule Law.<br />

Within five days after the taking of effect of a local law, the Clerk of the <strong>County</strong> Legislature<br />

shall file a certified copy thereof in the office of the <strong>County</strong> Clerk and three copies in the<br />

office of the Secretary of State. Such certified copy shall contain the text only of the local law<br />

without the brackets and the matter within the brackets or the italicizing or underscoring, if<br />

any, to indicate the changes made by it. At the same time the Clerk of the <strong>County</strong> Legislature<br />

shall cause to be published at least once as a <strong>County</strong> charge in the designated newspaper of<br />

general circulation published in the <strong>County</strong> a notice that such local law was adopted, a brief<br />

description of such local law and that the full text of such local law may be examined during<br />

regular business hours in the office of the Clerk of the <strong>County</strong> Legislature, provided that<br />

failure to do so shall not affect the validity of such local law.<br />

§ A210. Filing and publication of local laws; judicial notice.<br />

The filing and publication of local laws shall be as provided by § 27 of the Municipal Home<br />

Rule Law, and the court shall take judicial notice of all local laws and of rules and regulations<br />

adopted pursuant thereto.<br />

§ A211. Referendum.<br />

A local law shall be subject to mandatory or permissive referendum when required by the<br />

Charter or applicable law. Where no mandatory or permissive referendum is so required, the<br />

<strong>County</strong> Legislature may nevertheless provide in a local law that a referendum shall be had or<br />

that it shall be subject to permissive referendum.<br />

§ A212. Effective date.<br />

After adoption, every local law shall become effective when filed in the office of the<br />

Secretary of the State of New York or on such later date as may be provided in said local law.<br />
