§ 102-5 CONSUMER PROTECTION § 102-8<br />

creditor from communicating with the debtor's employer to execute a wage<br />

assignment agreement if the debtor has consented to such an agreement or has<br />

been authorized by an appropriate court order.<br />

(2) Said alleged creditor, his assignee, agent or employee informs or misleads the<br />

debtor of the existence of legal services or a governmental agency sanction when<br />

such is not the case.<br />

(3) Contact, other than the service of judicial process, with the alleged debtor by an<br />

alleged creditor or his assignee, agent or employee is attempted at hours of the day<br />

or night considered not to be reasonable, or with such frequency considered not to<br />

be reasonable. Such contact with the debtor or any member of his or her family at<br />

the debtor's residence between the hours of 10:00 p.m. and 6:30 a.m. shall be<br />

deemed a violation of this subsection.<br />

K. Renting or leasing power or mechanical equipment to consumers unless such rental or<br />

lease includes a warning to the consumer, in writing, of the potential danger resulting<br />

from the careless use of the equipment or lack of knowledge as to how such equipment is<br />

operated. In addition, said person, firm, partnership or corporation must also, at the time<br />

of the rental or lease, offer to provide to the consumer any instruction, handbooks or<br />

safety information provided by the manufacturer. [Added 8-25-1987 by L.L. No.<br />

§ 102-6. Administration.<br />

Administration of this code shall be under the supervision of the Consumer Services<br />

Specialist.<br />

§ 102-7. Unlawful acts.<br />

Deceptive trade practices and unconscionable trade practices are hereby declared unlawful in<br />

the <strong>County</strong> of <strong>Broome</strong>, New York.<br />

§ 102-8. Powers and duties of Consumer Services Specialist.<br />

The Consumer Services Specialist shall have the following powers and duties:<br />

A. To receive and investigate and refer, where appropriate, consumer complaints regarding<br />

business and commercial practices throughout the county.<br />

B. To receive and refer all consumer complaints and other matters involving members of a<br />

nonprofit association or corporation which has adopted an ethical code of conduct to<br />

which its members are required to subscribe to such association or corporation for<br />

resolution to the extent practicable by conference, conciliation and persuasion. In<br />

addition to the above, the Consumer Services Specialist shall have the right to enforce<br />

the provisions of this code without referral to the association or corporation where, in his<br />
