§ 98-1 BROOME COUNTY CODE § 98-2<br />

buildings and structures or the installation and use of materials and equipment<br />

therein or the location, use and occupancy thereof for all buildings, premises and<br />

equipment or activities within the authority of the code enforcement official as set<br />

forth in Subsection A above.<br />

(2) The Commissioner shall promulgate the rules and regulations subject to the<br />

approval of the <strong>County</strong> Legislature to secure the intent and purposes of this Article<br />

and the proper enforcement of the laws, ordinances, rules and regulations<br />

governing building plans, specifications, construction, alteration or repairs. The<br />

Commissioner shall publish all rules and regulations as least 14 days prior to the<br />

effective date thereof in a newspaper of general circulation within the areas that<br />

the <strong>County</strong> of <strong>Broome</strong> has the responsibility for enforcement of said code.<br />

C. Acting code enforcement official. In the absence of the code enforcement official, or in<br />

the case of his inability to act for any reason, the <strong>County</strong> Executive shall have the power<br />

to designate a person to act on behalf of the code enforcement official and to exercise all<br />

the powers conferred upon him by this Article.<br />

D. Appointment of inspectors. The code enforcement official may appoint one inspector or<br />

more as the need may arise to act under his/her supervision and direction and to exercise<br />

any portion of the powers and duties of the code enforcement official, as he/she shall be<br />

directed to do.<br />

E. Contracts.<br />

(1) The <strong>Broome</strong> <strong>County</strong> Legislature does hereby establish the authority of the code<br />

enforcement official to negotiate a renewable one-year contract with a qualified<br />

private firm to provide specific services relative to the administration of the New<br />

York State Uniform Fire Prevention and Building Code. The negotiated contract<br />

shall be approved by a majority vote of the <strong>Broome</strong> <strong>County</strong> Legislature.<br />

(2) The contractor shall perform inspections as provided for in this Article and shall<br />

review applications for building permits and certificates of occupancy and shall<br />

advise the Code Enforcement Official when such permits or certificates of<br />

occupancy should be issued.<br />

F. Board of Review. Where practicable difficulties or unnecessary hardship may result from<br />

enforcement of the strict letter of any provision of the Uniform Code, applications for<br />

variances consistent with the spirit of the code may be made to the regional Board of<br />

Review in accordance with Part 450 of the New York Code of Rules and Regulations,<br />

entitled "Uniform Code: Board of Review," as promulgated by the New York<br />

Department of State. The Code Enforcement Official shall maintain a copy of such rules<br />

and regulations for public inspection and shall obtain and retain a copy of all decisions<br />

rendered by the Board of Review pertaining to matters affecting the <strong>County</strong> of <strong>Broome</strong>.<br />

§ 98-2. Building permits.<br />

A. Except as hereinafter provided, no person, firm, corporation, association or other<br />

organization shall commence the erection, construction, enlargement, alteration,<br />
