(B) Expenditure from a petty cash fund may be made only for payment, as authorized by the<br />

Comptroller in advance of audit, of properly itemized and verified or certified bills for<br />

materials, supplies or services other than regular employment, furnished to the <strong>County</strong><br />

for the conduct of its affairs, and upon terms calling for payment to the vendor upon the<br />

delivery of any such materials or supplies or the rendering of any such services. Moneys<br />

in any such fund also may be used for the purpose of making change when such is<br />

required in the performance of official duties. Moneys in any such fund established for<br />

the Offices of the Sheriff, District Attorney or Public Defender may also be used to<br />

advance travel funds to personnel of the Sheriff's, District Attorney's or Public Defender's<br />

Office when required to travel on official business.<br />

(C) Upon audit of bills, the petty cash fund shall be reimbursed from the appropriate<br />

budgetary item or items in the amount equal to the amount audited and allowed. The<br />

Comptroller immediately shall notify the Commissioner of Finance, in writing, of the<br />

disallowance of any such bills or any portion thereof, stating the amount in each case<br />

disallowed and the reason therefor. Any of such bills or any portion thereof as shall be<br />

disallowed upon audit shall be the personal liability of the official responsible for the use<br />

of the petty cash fund from which payment on account thereof was made. Such official,<br />

upon direction of the Comptroller, shall forthwith reimburse the petty cash fund in the<br />

amount disallowed. If such reimbursement is not promptly made, the amount thereof<br />

shall be deducted from the official's salary by order of the Comptroller and paid into the<br />

petty cash fund until repaid in full.<br />

A<strong>RT</strong>ICLE III<br />

Executive Branch<br />

§ A301. <strong>County</strong> Executive; elective <strong>County</strong> Executive; term. [Amended 4-4-1991 by<br />

L.L. No. 10-1991]<br />

The Executive Branch of the <strong>County</strong> government shall be administered by the <strong>County</strong><br />

Executive.<br />

An elective <strong>County</strong> Executive shall be elected at the general election in November for a term<br />

of four years.<br />

No elective official of any town, village, city, <strong>County</strong> or any other municipality shall be<br />

eligible to hold the office of <strong>County</strong> Executive. The <strong>County</strong> Executive shall not be an officer,<br />

director or a stockholder of any depositary of <strong>County</strong> funds. The <strong>County</strong> Executive shall be<br />

required to give his whole time to the duties of his office and shall not engage in the practice<br />

of any profession or the conduct of any business, trade, occupation or employment. Nothing<br />

contained herein, however, shall preclude the <strong>County</strong> Executive from receiving income<br />

derived from personally held investments or securities, from rentals or from businesses,<br />

partnerships or corporations in which he may have an interest, so long as he does not actively<br />

participate in the operation or conduct thereof.<br />
