§ 225-3 RECORDS, PUBLIC ACCESS TO<br />

§ 225-3<br />

(2) If the officer determines that the record requested may not be in the custody of<br />

<strong>Broome</strong> <strong>County</strong>, the officer shall send a letter to the applicant within five business<br />

days of receipt of the request. The letter shall:<br />

(a)<br />

(b)<br />

(c)<br />

(d)<br />

Acknowledge receipt of the request;<br />

Inform the applicant that an attempt is being made to locate the records<br />

requested;<br />

Inform the applicant that the request shall be granted or denied within the<br />

next 10 business days; and<br />

Inform the applicant that disclosure will be determined in accordance with<br />

the Public Officers Law.<br />

(3) The officer shall notify the relevant county department of the request and the need<br />

for completion of a search for the record within 10 business days.<br />

(4) If the officer determines that the record requested is in the custody of <strong>Broome</strong><br />

<strong>County</strong>, the officer shall send a letter to the applicant within five business days of<br />

receipt of the request. The letter shall:<br />

(a)<br />

(b)<br />

(c)<br />

(d)<br />

Acknowledge receipt of the request; and<br />

Advise the applicant that the record is available for inspection upon<br />

appointment or that copies will be provided upon receipt of payment of the<br />

appropriate fee, plus postage if said copies are to be mailed; or<br />

Advise the applicant that disclosure of the record is denied in accordance<br />

with the Public Officers Law, together with the reasons for such denial, and<br />

inform the applicant of the right to appeal such denial to the <strong>County</strong><br />

Attorney; or<br />

Advise the applicant that the request is being reviewed in accordance with<br />

the Public Officers Law and that the request shall be granted or denied within<br />

the next 10 business days.<br />

B. The Deputy <strong>County</strong> Attorney of the Department of Social Services shall be designated as<br />

the records access officer for all social services records. Any person wishing to inspect<br />

and/or obtain a copy of any record of the Department of Social Services may make<br />

application to the Deputy <strong>County</strong> Attorney of said Department. Such application may be<br />

made, orally or in writing, on any workday at the office of the Deputy <strong>County</strong> Attorney,<br />

36-38 Main Street, Binghamton, New York, between the hours of 9:00 a.m. and 5:00<br />

p.m. Within five business days of the receipt of such an application, the Deputy <strong>County</strong><br />

Attorney shall send a letter to the applicant stating the following:<br />

(1) The record requested is available for inspection upon appointment or copies will be<br />

provided upon receipt of payment of the appropriate fee, plus postage if said<br />

copies are to be mailed; or<br />
