§ A302 BROOME COUNTY ADMINISTRATIVE CODE § A302<br />

§ A302. Powers and duties.<br />

The <strong>County</strong> Executive shall have all the powers and duties and shall be subject to all the<br />

obligations and liabilities heretofore or hereafter lawfully granted or imposed by the Charter,<br />

Code or any applicable provision of any act of the State Legislature, local law, ordinance or<br />

resolution of the <strong>County</strong> Legislature not inconsistent with the Charter or Code.<br />

In addition to any other powers and duties, the <strong>County</strong> Executive shall have the following<br />

duties and functions:<br />

(A) Be the chief executive officer and administrative head of the <strong>County</strong> government.<br />

(B) Supervise and direct the internal organization and reorganization of any administrative<br />

unit the head of which he has the power to appoint, which supervision and direction may<br />

include the organization and reorganization of any such administrative unit into divisions,<br />

bureaus, sections or other subordinate parts, and make such assignments of powers and<br />

duties among them as he may consider advisable.<br />

(C) Be the Chief Budget Officer of the <strong>County</strong> and be responsible for preparation of the<br />

proposed tentative budget and capital program of the <strong>County</strong>.<br />

(D) Determine and fix real property tax equalization rates among the various taxing districts<br />

of the <strong>County</strong> for <strong>County</strong> purposes. On or before the first day of November in each year,<br />

after reviewing the proposed <strong>County</strong> tax equalization rates submitted to him by the<br />

Commissioner of Finance, and after obtaining such additional information or holding<br />

such hearings thereon as he may deem necessary or advisable, the <strong>County</strong> Executive<br />

shall file said rates, together with an abstract of evidence upon which the rates are based,<br />

with the <strong>County</strong> Legislature. The proposed rates shall be subject to confirmation and<br />

revision by the <strong>County</strong> Legislature, and the <strong>County</strong> Executive shall have no veto power<br />

over the final determination by the <strong>County</strong> Legislature. If the <strong>County</strong> Legislature fails to<br />

act by a majority vote upon these proposed rates by the 20th day of November, the<br />

determination by the <strong>County</strong> Executive of the tax equalization rates shall be final. The<br />

documentary evidence used in determining the <strong>County</strong> equalization rates shall be<br />

preserved by the <strong>County</strong> Executive, and an abstract of the same shall be published with<br />

the <strong>County</strong> equalization rates in the proceedings of the <strong>County</strong> Legislature. 3<br />

(E) Appoint and terminate one or more temporary advisory boards or committees of citizens<br />

of the <strong>County</strong> who shall, without compensation other than such necessary expenses as<br />

may be provided in the budget, advise in the consideration of <strong>County</strong> administrative<br />

policies and programs.<br />

(F)<br />

File an annual report to the <strong>County</strong> Legislature required by § C302(H) of Article III of<br />

the Charter; present to the <strong>County</strong> Legislature, from time to time, pertinent information<br />

concerning the affairs of <strong>County</strong> government as he may deem necessary, or the <strong>County</strong><br />

Legislature by resolution may require; and recommend, from time to time, such measures<br />

in connection with the affairs of <strong>County</strong> government as he shall deem necessary.<br />
