§ 76-9 BROOME COUNTY CODE § 76-13<br />

Other payments of liabilities of the plan shall be made by the Commissioner of Finance upon<br />

vouchers duly audited by the Committee appointed to supervise the plan.<br />

§ 76-10. Powers and duties of Committee.<br />

The Committee of the <strong>County</strong> Legislature appointed to supervise the plan shall have general<br />

supervision of the plan; shall appoint the Secretary and other employees of the plan within the<br />

limits of the appropriation therefor; and shall audit all bills or claims against the plan before<br />

payment, except such sums as may be payable under § 25 of the Workers' Compensation Law<br />

and awards of the Workers' Compensation Board.<br />

§ 76-11. Powers and duties of Secretary.<br />

The Secretary shall perform such duties as may be necessary to operate the plan in accordance<br />

with the Workers' Compensation law; shall attend hearings of cases before the Workers'<br />

Compensation Board; shall have the power to authorize necessary medical care which appears<br />

from medical reports and information to be justifiable; and shall have the authority to<br />

purchase supplies, stationery, forms, books and equipment as may be necessary for the<br />

operation of said plan within the limits of the appropriation and subject to the rules of the<br />

<strong>County</strong> Legislature of <strong>Broome</strong> <strong>County</strong>.<br />

§ 76-12. Penalties for offenses.<br />

The violation of any of the provisions of this Article by any participant shall be grounds for<br />

the expulsion of such participant from the plan.<br />

Apportionments to Participants<br />

§ 76-13. Definitions.<br />

As used herein, the following terms shall have the following meanings:<br />

PERCENTAGE OF EXPERIENCE OF PA<strong>RT</strong>ICIPANTS — The total of all medical and<br />

compensation paid to employees of participants during the four-year period preceding the<br />

preparation of the budget divided by the total of all medical and compensation paid by the<br />

plan during the four-year period preceding the preparation of the budget; however, if a<br />

four-year experience is not practicable or available, the administrator of the plan may use such<br />

other period as may be equitable.<br />

PERCENT OF PAYROLL OF PA<strong>RT</strong>ICIPANTS — The total payroll of all participants as of<br />

June 30 preceding the budget divided by the total payroll of all the participants.<br />

TOTAL ASSESSED VALUATION — The assessed valuation of all the participants of the<br />

plan as of the preceding June 30 next to the preparation of the budget.<br />

TOTAL REVENUE — The revenue to be raised by participants.<br />
