§ 115-6. Applicability.<br />

In accordance with § 2145 of the Public Health Law of the State of New York, this Article<br />

shall not apply to dogs owned by a nonresident while passing through any town, city or<br />

village, nor to dogs brought into any town, city or village for a period not exceeding 15 days,<br />

if entered in any exhibition at any dog show therein and if confined and in immediate charge<br />

of the exhibitor, or to dogs actually confined to the premises of incorporated societies devoted<br />

to the care or hospital treatment of lost, strayed or homeless animals, or confined to the<br />

premises of public or private hospitals devoted to the treatment of sick animals, or confined<br />

for the purposes of research to the premises of colleges or other educational or research<br />

institutions, or to dogs actually confined to the premises of a person, firm or corporation<br />

actually engaged in the business of breeding or raising dogs for profit and which is so<br />

licensed as a Class A dealer under the Federal Laboratory Animal Welfare Act.<br />

§ 115-7. Conduct of required vaccination.<br />

In accordance with § 2145 of the Public Health Law of the State of New York, compulsory<br />

antirabies vaccination of all dogs in <strong>Broome</strong> <strong>County</strong> which are six months of age or older<br />

shall be required. Such vaccination shall be conducted under the direction of the <strong>Broome</strong><br />

<strong>County</strong> Health Department, and the cost thereof shall be a <strong>County</strong> charge to be paid in the<br />

manner that other <strong>County</strong> expenses are paid; provided, however, that nothing contained herein<br />

shall be construed to require the <strong>County</strong> to pay for any vaccination or vaccination services<br />

rendered pursuant to any contract or agreement to which the <strong>County</strong> is not a party.<br />

§ 115-8. Enforcement.<br />

In accordance with § 109 of the Agriculture and Markets Law of the State of New York and<br />

§ 2145 of the Public Health Law of the State of New York, this Article shall be enforced as<br />

follows:<br />

A. At the time of issuing any dog license as provided in § 109 of the Agriculture and<br />

Markets Law, the Clerk or authorized Dog Control Officer shall require the applicant to<br />

present a statement certified by a licensed veterinarian showing that the dog or dogs have<br />

been vaccinated to prevent rabies or, in lieu thereof, a statement certified by a licensed<br />

veterinarian that because of old age or other reason, the life of the dog or dogs would be<br />

endangered by the administration of vaccine. The Clerk or authorized Dog Control<br />

Officer shall make or cause to be made from such statement a record of such information<br />

as may be required by the Commissioner of Health of the State of New York and shall<br />

file such record with a copy of the license.<br />

§ 115-9. Penalties for offenses.<br />

Any owner of a dog willfully failing or refusing to submit his dog or dogs immediately for<br />

vaccination upon request by a dog control officer, a peace officer acting pursuant to his<br />

special duties, police officer or health officer shall be guilty of a misdemeanor and shall be<br />

subjected to a fine of not more than $25.<br />
