(2) Disclosure of the record is denied in accordance with the Public Officers Law,<br />

together with the reasons for such denial. The applicant shall also be informed of<br />

the right to appeal such denial to the <strong>County</strong> Attorney; or<br />

(3) The request is being reviewed in accordance with the Public Officers Law and<br />

shall be granted or denied within the next 10 business days.<br />

C. The <strong>Broome</strong> <strong>County</strong> Board of Elections shall be the custodian of all records required to<br />

be open for public inspection by the New York State Election Law. A list of such records<br />

is attached hereto as "Exhibit A." 1 All requests for copies of these records, which<br />

requests may be oral or in writing, shall be honored upon payment of the appropriate fee,<br />

plus first class postage if said copies are to be mailed. Requests for any other records of<br />

the <strong>Broome</strong> <strong>County</strong> Board of Elections shall be made to the Clerk of the <strong>Broome</strong> <strong>County</strong><br />

Legislature in the manner provided herein.<br />

§ 225-4. Fees. [Added 6-24-1986 by Res. No. 201; amended 5-21-1998 by Res. No.<br />

98-170]<br />

A. The fee for photocopies of records provided by the officer and not in excess of nine<br />

inches by fourteen 14 inches shall be $0.25 per page. The fee for photocopies of any<br />

other records shall be the actual per-page reproduction cost as determined by the<br />

appropriate department head. The Records Access Officer shall have the authority to<br />

waive any photocopying fees whenever the cumulative fee required by the foregoing<br />

sentences is less than or equal to $1.<br />

B. The fee for photocopies of records provided by the Deputy <strong>County</strong> Attorney of the<br />

Department of Social Services shall be as follows:<br />

(1) For an applicant requesting documents pertaining to his or her case and which<br />

relate to a fair hearing, as determined by the Deputy <strong>County</strong> Attorney, copies shall<br />

be free.<br />

(2) For an applicant requesting documents pertaining to his or her case other than<br />

those relating to a fair hearing, copies shall be $0.10 per page. The records access<br />

officer shall have the authority to waive any photocopying fees whenever the<br />

cumulative fee required by the foregoing sentences is less than or equal to $1.<br />

(3) For an applicant requesting documents pertaining to any record other than the<br />

above, the fee for copies shall be as stated in Subsection A above.<br />

C. The fee for photocopies of records provided by the Board of Elections shall be the same<br />

as above, except where a different charge is specified by the Election Law.<br />

§ 225-5. Invasions of privacy. [Added 6-24-1986 by Res. No. 201]<br />

In accordance with the provisions of Subdivision 2 of § 89 of the Public Officers Law and in<br />

conformity with such guidelines as may be promulgated by the Committee on Open<br />
