§ C304 BROOME COUNTY CHA<strong>RT</strong>ER AND CODE § C306<br />

§ C304. Deputy <strong>County</strong> Executives; appointment; duties. [Amended 8-17-1982 by L.L.<br />

No. 9-1982; 10-4-1983 by L.L. No. 14-1983]<br />

The <strong>County</strong> Executive may appoint three (3) Deputy <strong>County</strong> Executives, subject to<br />

confirmation by the <strong>County</strong> Legislature, who shall hold office at the pleasure of the <strong>County</strong><br />

Executive. The Deputy <strong>County</strong> Executives shall have the authority to act generally for and in<br />

place of the <strong>County</strong> Executive. The appointment and confirmation of Deputy <strong>County</strong><br />

Executives shall be in the same manner as the appointment and confirmation of the heads of<br />

departments or other administrative units.<br />

The <strong>County</strong> Executive shall designate, in writing, a Deputy <strong>County</strong> Executive who shall be a<br />

Deputy for Administration, a Deputy <strong>County</strong> Executive who shall be a Deputy for Physical<br />

Services and a Deputy <strong>County</strong> Executive who shall be a Deputy for Human Services, without<br />

impairing their authority to act generally for and in place of the <strong>County</strong> Executive. Such<br />

designation shall be made, in writing, at the time of appointment, and no appointment shall be<br />

valid unless said designation is made. A change in designation shall be made in the same<br />

manner as an appointment and shall be subject to confirmation by the <strong>County</strong> Legislature in<br />

the same manner as an appointment.<br />

The <strong>County</strong> Executive may designate, in writing, the order of succession among the Deputy<br />

<strong>County</strong> Executives for performing the duties of the <strong>County</strong> Executive during the latter's<br />

inability to perform by reason of absence from the <strong>County</strong> or disability. Such designation<br />

shall be filed with the Clerk of the <strong>County</strong> Legislature, and any such designation may be<br />

revoked or modified, in writing, at any time by the <strong>County</strong> Executive by filing with the Clerk<br />

of the Legislature a revocation or a new designation. In the event that the <strong>County</strong> Executive<br />

does not designate an order of succession among the Deputy <strong>County</strong> Executives, then the<br />

order of succession shall be first, the Deputy for Administration; second, the Deputy for<br />

Physical Services; and third, the Deputy for Human Services.<br />

§ C306. Acting <strong>County</strong> Executive; how designated; when to act; appointment; duties.<br />

[Amended 10-4-1983 by L.L. No. 14-1983]<br />

The <strong>County</strong> Executive may designate, in writing, one (1) or more appointive department or<br />

executive division heads to perform the duties of the <strong>County</strong> Executive as hereinafter<br />

provided. Such appointment, with the order of succession specified, shall be filed with the<br />

Clerk of the <strong>County</strong> Legislature, and any such designation may be revoked at any time by the<br />

<strong>County</strong> Executive by filing a new designation with the Clerk of the <strong>County</strong> Legislature.<br />

The Acting <strong>County</strong> Executive shall perform the duties of the <strong>County</strong> Executive:<br />

(1) If no Deputy <strong>County</strong> Executives have been appointed pursuant to § C304 herein and the<br />

<strong>County</strong> Executive is unable to perform his duties by reason of absence from the <strong>County</strong><br />

or disability; or<br />
