an amount equal to its share of future administration costs thirty (30) days prior to
the date of its withdrawal from the plan. 2
§ 76-5. Duties of participants.
All participants in the plan shall cooperate fully with the Committee and Secretary in the
administration of the plan, shall render such reports as may be required and shall promptly
furnish all pertinent information relative to any claim and aid in the investigation of any
claim.
§ 76-6. Medical history check; physical examinations.
Every new employee or any participant in the plan shall be required to furnish a medical
history, on a form to be provided by the Personnel Department, such history to be reviewed
by a qualified health professional selected by the Personnel Department. If, in the opinion of
the qualified health professional reviewing the medical history, a physical examination is
warranted, the employee shall submit to a physical examination to be conducted by a
representative of the Broome County Health Department before undertaking any of the duties
of his employment, except in the case of an emergency, in which case the participant
employing such employee shall arrange for such physical examination at the earliest possible
time after such undertaking of duties. The expense of such physical examinations shall be
paid from the funds of the plan. All medical reports shall be filed immediately with the
Broome County Department of Personnel.
§ 76-7. Shares of each participant.
The share of each participant in the plan shall be collected as provided in § 67 of the Workers'
Compensation Law, except that the share of the towns participating in the plan shall be
collected by inclusion in the next succeeding tax levy.
§ 76-8. Reserve fund. [Amended 12-12-1991 by L.L. No. 15-1991]
A self-insurance reserve for the plan is hereby established. The maximum amount which may
be contributed to such reserve shall be five hundred thousand dollars ($500,000.). A sum not
in excess of ten percent (10%) of said reserve fund shall be included in each year's budget
until the full amount of said reserve is reached. If said reserve should at any time fall below
the established amount, such sum as is necessary to bring it to the established amount shall be
included in the next budget.
§ 76-9. Payment of benefits.
The Commissioner of Finance shall pay to claimants workers' compensation benefits as
provided in § 25 of the Workers' Compensation Law upon order of the Secretary of the plan.
