an amount equal to its share of future administration costs thirty (30) days prior to<br />

the date of its withdrawal from the plan. 2<br />

§ 76-5. Duties of participants.<br />

All participants in the plan shall cooperate fully with the Committee and Secretary in the<br />

administration of the plan, shall render such reports as may be required and shall promptly<br />

furnish all pertinent information relative to any claim and aid in the investigation of any<br />

claim.<br />

§ 76-6. Medical history check; physical examinations.<br />

Every new employee or any participant in the plan shall be required to furnish a medical<br />

history, on a form to be provided by the Personnel Department, such history to be reviewed<br />

by a qualified health professional selected by the Personnel Department. If, in the opinion of<br />

the qualified health professional reviewing the medical history, a physical examination is<br />

warranted, the employee shall submit to a physical examination to be conducted by a<br />

representative of the <strong>Broome</strong> <strong>County</strong> Health Department before undertaking any of the duties<br />

of his employment, except in the case of an emergency, in which case the participant<br />

employing such employee shall arrange for such physical examination at the earliest possible<br />

time after such undertaking of duties. The expense of such physical examinations shall be<br />

paid from the funds of the plan. All medical reports shall be filed immediately with the<br />

<strong>Broome</strong> <strong>County</strong> Department of Personnel.<br />

§ 76-7. Shares of each participant.<br />

The share of each participant in the plan shall be collected as provided in § 67 of the Workers'<br />

Compensation Law, except that the share of the towns participating in the plan shall be<br />

collected by inclusion in the next succeeding tax levy.<br />

§ 76-8. Reserve fund. [Amended 12-12-1991 by L.L. No. 15-1991]<br />

A self-insurance reserve for the plan is hereby established. The maximum amount which may<br />

be contributed to such reserve shall be five hundred thousand dollars ($500,000.). A sum not<br />

in excess of ten percent (10%) of said reserve fund shall be included in each year's budget<br />

until the full amount of said reserve is reached. If said reserve should at any time fall below<br />

the established amount, such sum as is necessary to bring it to the established amount shall be<br />

included in the next budget.<br />

§ 76-9. Payment of benefits.<br />

The Commissioner of Finance shall pay to claimants workers' compensation benefits as<br />

provided in § 25 of the Workers' Compensation Law upon order of the Secretary of the plan.<br />
