Department of Health<br />

§ C701. Department of Health; Commissioner or Director; appointment; qualifications.<br />

[Amended 4-3-1979 by L.L. No. 6-1979]<br />

There shall be a Department of Health, headed by a Commissioner or a Director who shall be<br />

appointed by the <strong>County</strong> Executive, subject to confirmation by the <strong>County</strong> Legislature, and<br />

shall serve at the pleasure of the <strong>County</strong> Executive.<br />

The Commissioner or Director of Health shall be experienced in public health administration<br />

and shall possess such qualifications as are prescribed in the State Sanitary Code or otherwise<br />

by the Public Health Council of the State of New York.<br />

§ C702. Powers and duties. [Amended 4-3-1979 by L.L. No. 6-1979]<br />

The Commissioner or Director of Health shall have all the powers and perform all the duties<br />

conferred or imposed upon <strong>County</strong> or Part-<strong>County</strong> Health Commissioners and/or <strong>County</strong> or<br />

Part-<strong>County</strong> Boards of Health by law, except as may otherwise be provided by this Charter or<br />

Administrative Code. In addition thereto, he shall perform such other and related duties as<br />

shall be required or delegated to him by the <strong>County</strong> Executive or the <strong>County</strong> Legislature.<br />

§ C703. Health Advisory Board.<br />

There shall be in the Department a Health Advisory Board. The Chairman of the <strong>County</strong><br />

Legislature shall be a member of this Board. The members of the Health Advisory Board shall<br />

be appointed in the manner as provided by the Administrative Code.<br />

§ C704. Sanitary Code. [Amended 4-3-1979 by L.L. No. 6-1979]<br />

The <strong>County</strong> Legislature shall adopt, amend or repeal all rules and regulations, orders and<br />

directions relating to health in the <strong>County</strong> or Part-<strong>County</strong> District in such manner and form<br />

provided in and not inconsistent with the Public Health Law or the State Sanitary Code. The<br />

Health Advisory Board may, subject to the approval of the Commissioner or Director,<br />

recommend and submit to the <strong>County</strong> Legislature for adoption, amendment or repeal thereof<br />

such rules, regulations, orders and directions relating to health in the <strong>County</strong> or Part-<strong>County</strong><br />

District, in such manner and form provided in and not inconsistent with the Public Health<br />

Law or the State Sanitary Code. Any such rules, regulations, orders and directions so adopted,<br />

amended or repealed by the <strong>County</strong> Legislature shall be known as the "<strong>Broome</strong> <strong>County</strong> or<br />

§ C705. Organization of the Department.<br />

The Department of Health shall be organized into such Divisions and Bureaus as shall be<br />

prescribed in the Administrative Code.<br />
