§ A1704 BROOME COUNTY ADMINISTRATIVE CODE § A1803<br />

designations shall be in writing and filed in the Department of Records, and copies thereof<br />

shall be filed with the <strong>County</strong> Executive and with the Clerk of the <strong>County</strong> Legislature.<br />

The Assistant and Deputy <strong>County</strong> Attorneys shall, in case of vacancy in the office of <strong>County</strong><br />

Attorney, perform the duties of the <strong>County</strong> Attorney until a successor is elected or appointed<br />

and has qualified.<br />

A<strong>RT</strong>ICLE XVIII<br />

Coroners<br />

§ A1801. Coroners; appointment; qualifications.<br />

There shall be four Coroners who shall be chosen in the manner as provided in § C1801 of<br />

Article XVIII of the Charter. Each Coroner shall be a physician duly licensed to practice in<br />

the State of New York. Each Coroner shall make or cause to be made autopsies, examinations<br />

and dissections of dead bodies of human beings and have adequate knowledge of forensic<br />

medicine.<br />

§ A1802. Powers and duties.<br />

The Coroners shall have all the powers and duties and shall be subject to all the obligations<br />

and liabilities heretofore or hereafter lawfully granted or imposed by the Charter, this Code,<br />

local law, ordinance or resolution of the <strong>County</strong> Legislature, order or direction of the <strong>County</strong><br />

Executive or any applicable provision of any act of the State Legislature not inconsistent with<br />

the Charter and Code. Such powers, duties, obligations and liabilities shall include, but shall<br />

not be limited to, any power, duty, obligation or liability granted or imposed upon a Coroner<br />

by the <strong>County</strong> Law or any other applicable law not inconsistent with the Charter and Code.<br />

The Coroner shall investigate deaths when such investigation is required pursuant to § A1803<br />

of this Article and applicable state law.<br />

§ A1803. Procedure for investigating deaths.<br />

A Coroner has jurisdiction and authority to investigate the death of every person dying within<br />

his <strong>County</strong>, or whose body is found within the <strong>County</strong>, which is or appears to be:<br />

(A) A violent death, whether by criminal violence, suicide or casualty.<br />

(B) A death caused by unlawful act or criminal neglect.<br />

(C) A death occurring in a suspicious, unusual or unexplained manner.<br />

(D) A death caused by suspected criminal abortion.<br />

(E) A death while unattended by a physician, so far as can be discovered, or where no<br />

physician able to certify the cause of death as provided in the Public Health Law and in<br />

form as prescribed by the Commissioner of Health can be found.<br />

(F)<br />

A death of a person confined in a public institution other than a hospital, infirmary or<br />

nursing home.<br />
