District Attorney<br />

§ A2101. District Attorney; election; term; qualifications.<br />

There shall be a District Attorney's Office headed by a District Attorney. The election of the<br />

District Attorney, together with his term of office, shall be as provided in Article XIII of the<br />

New York State Constitution and § 400 of the <strong>County</strong> Law of the State of New York. At the<br />

time of his election and throughout his term of office, he shall be a qualified elector of the<br />

<strong>County</strong>. Throughout his term of office, the District Attorney and his Assistants shall devote<br />

their whole time to the duties of their office, shall hold no other elective office and shall hold<br />

no other public office or be engaged in any employment, business or professional activity<br />

with any government unit without compliance with § 2610 of the Charter. The District<br />

Attorney and the Assistant District Attorneys shall be precluded from the private practice of<br />

law whatsoever.<br />

§ A2102. Powers and duties.<br />

The District Attorney shall have and exercise all the powers and duties heretofore or hereafter<br />

lawfully granted or imposed by the Charter, this Code, local law, ordinance or resolution of<br />

the <strong>County</strong> Legislature, order or direction of the <strong>County</strong> Executive not inconsistent with those<br />

powers and duties under the New York State Constitution vesting in said office.<br />

§ A2103. Reports.<br />

On or before March 1 in each year, the District Attorney shall make an annual report for the<br />

immediate preceding calendar year, covering generally the work of his Office. The District<br />

Attorney shall make such other reports at such times as may be required by the <strong>County</strong><br />

Legislature, <strong>County</strong> Executive or any other applicable law. Copies of all reports shall be filed<br />

with the Clerk of the <strong>County</strong> Legislature and the <strong>County</strong> Executive.<br />

§ A2104. Assistant District Attorneys.<br />

The District Attorney shall appoint such Assistant District Attorneys as shall be authorized by<br />

the <strong>County</strong> Legislature. All Assistant District Attorneys shall serve at the pleasure of the<br />

District Attorney. The District Attorney shall designate an Assistant or Assistants to whom<br />

shall be delegated all the powers and duties of the District Attorney when such District<br />

Attorney is unable to act by reason of absence or disability. The designation or designations<br />

shall be in writing and filed in the Department of Records, and copies thereof shall be filed<br />

with the <strong>County</strong> Executive and with the Clerk of the <strong>County</strong> Legislature.<br />

The Assistant District Attorneys shall, in case of vacancy in the office of District Attorney,<br />

perform the duties of the District Attorney until a successor is elected or appointed and has<br />

qualified.<br />
