shall be open to the public, and the Board shall be required to keep written minutes of its<br />

proceedings, which shall be available to public inspection at all reasonable times.<br />

The Board of Acquisition and Contract shall adopt rules of procedure for the conduct of its<br />

meetings and shall establish its regular meeting dates.<br />

The Board of Acquisition and Contract shall have and exercise all powers and duties<br />

conferred or imposed upon it by the Charter and this Code. The members of such Board shall<br />

receive no additional salary or compensation for their services, but shall, within the<br />

appropriations provided therefor, be entitled to actual and necessary disbursements and<br />

expenses in performing the duties of their office.<br />

The Board of Acquisition and Contract may make recommendations to the <strong>County</strong> Legislature<br />

relative to the operations of the Board and <strong>County</strong> contracts.<br />

§ A1202. Approval of professional service contracts. [Amended 10-15-1992 by L.L. No.<br />

13-1992; 8-15-1996 by L.L. No. 6-1996; 5-15-2008 by L.L. No. 2-2008]<br />

The Board of Acquisition and Contract shall award all contracts for professional services<br />

involving expenditures of $15,000 or less, except that the award of contracts for expert<br />

witness services for litigation shall be in accordance with the provisions of the <strong>Broome</strong><br />

<strong>County</strong> Purchase Procurement Process Manual.<br />

§ A1203. Approval and execution of public work contracts. [Amended 3-7-1979 by L.L.<br />

No. 2-1979; 8-17-1982 by L.L. No. 7-1982; 10-4-1983 by L.L. No. 16-1983; 8-14-1984 by<br />

L.L. No. 5-1984; 10-15-1992 by L.L. No. 12-1992; 11-24-1992 by L.L. No. 15-1992;<br />

8-17-1995 by L.L. No. 14-1995; 12-23-1997 by L.L. No. 1-1998]<br />

The Board of Acquisition and Contract shall award all public works contracts involving an<br />

expenditure of more than $1,000. Public works contracts involving $1,000 or less shall be<br />

awarded by the Director of Purchasing. In either case, no public works contract shall be<br />

deemed effective until a written agreement approved by the Department of Law has been<br />

executed by the <strong>County</strong> Executive and the Contractor.<br />

Whenever a public works contract involves the expenditure of more than $15,000, which is<br />

the sum fixed by the General Municipal Law of the State of New York as the monetary limit<br />

above which the competitive bidding process must be employed, the contract shall be awarded<br />

to the lowest responsible bidder by sealed bids or proposals made in compliance with a public<br />

notice published at least once in a newspaper designated by the Board of Acquisition and<br />

Contract at least 10 days prior to the day on which such sealed bids are to be opened. Such<br />

advertisements shall contain a statement of the time and place when and where all bids<br />

received pursuant to such notice will be publicly opened and read. The Board of Acquisition<br />

and Contract or its designated representative or representatives shall open the bids publicly at<br />

the time and place specified and shall make a record of such bids in form and detail<br />

prescribed by the Board of Acquisition and Contract. The successful bidder must give security<br />

for the faithful performance of his contract, the adequacy and sufficiency of which shall be<br />

approved by the Board of Acquisition and Contract. In cases where two or more responsible<br />

bidders, furnishing the required security, submit identical bids as to price, the Board of<br />
