Wireless Communications Surcharge

§ 125-32. Definitions.
As used in this article, the following terms shall have the meanings indicated:
COUNTY — The County of Broome.
ELIGIBLE WIRELESS 911 SERVICE COSTS — The costs defined in § 325(16) of the
County Law.
PLACE OF PRIMARY USE — The street address that is representative of where the
customer’s use of the wireless communications service primarily occurs which must be the
residential street address or the primary business street address of the customer; and within the
licensed service area of the wireless communications service supplier.
WIRELESS COMMUNICATION DEVICE — Any equipment used to access wireless
communications service.
WIRELESS COMMUNICATION SERVICE — All commercial mobile services, as that term
is defined in Section 332(d) of Title 47, United States Code, as amended from time to time,
including, but not limited to, all broadband personal communications services, wireless radio
telephone services, geographic area specialized and enhanced specialized mobile radio
services, and incumbent- wide area specialized mobile radio licensees, which offer real time,
two-way voice or data service that is interconnected with the public switched telephone
network or otherwise provides access to emergency communications services.
§ 125-33. Amount of surcharge; effective date.
Effective January 1, 2004, a surcharge of $0.30 per month shall be imposed on each wireless
communications device that is served by wireless communications service rendered to a
customer whose place of primary use is located in Broome County.
§ 125-34. Billing.
The surcharge imposed pursuant to § 125-33 above shall be reflected and made payable on
bills rendered for wireless communications service.
§ 125-35. Collection by service supplier; remittal to County.
A. Each wireless communications service supplier serving the County shall act as a
collection agent for the County and shall remit the funds collected pursuant to a
surcharge imposed under the provisions of this article to the chief fiscal officer of the
County every month. Such funds shall be remitted no later than 30 days after the last
business day of the month.
