§ 158-4 PARKS AND RECREATION AREAS<br />

Q. Balloon launch permit: $25 per year. [Added 4-14-1992 by L.L. No. 4-1992 11 ]<br />

NOTE No. 1: Any person or group wishing to sponsor or engage in any special activity<br />

is required to obtain written permission for such activity from the Commissioner, who<br />

may charge the person or group so engaged a percentage of any cash receipts or for<br />

any extra expenses incurred by the Department as a result of such activity.<br />

NOTE No. 2: Prices charged at snack bars administered by the Department are set by<br />

the Commissioner and are comparable to those being charged for similar products by<br />

established retail outlets in the proximity of the park.<br />

NOTE No. 3: The Department will follow a strict policy of no refunds, except as<br />

outlined in specific contracts or as deemed appropriate by the Commissioner of Parks<br />

and Recreation in extenuating circumstances. [Amended 12-29-1994 by L.L. No.<br />

2-1995]<br />

NOTE No. 4: Lost equipment or equipment damaged beyond repair will be billed at<br />

one-third ( 1/3) the replacement cost.<br />

NOTE No. 5: The Commissioner of Parks and Recreation has the right to require<br />

additional security and emergency medical services coverage from a promoter or<br />

registered group for an event and appropriately charge said group or promoter for said<br />

services.<br />

NOTE No. 6: Seasonal uniform. <strong>Broome</strong> <strong>County</strong> Parks and Recreation Department is<br />

authorized to allocate a minimum number of uniforms to those seasonal employees<br />

who are required to wear them in order to adequately perform their job duties in a safe<br />

and professional manner. [Added 1-30-1997 by L.L. No. 1-1997]<br />

§ 158-5. Penalties for offenses.<br />

Any violation of any provision of the foregoing rules and regulations or any amendment<br />

thereto shall be deemed a violation, and any person found guilty thereof shall be liable to a<br />

fine which shall not exceed $500 or imprisonment not to exceed 30 days, or both such fine<br />

and imprisonment, or, at the discretion of the Commissioner, be banned from the parks for a<br />

period of time specified in writing. Persons so notified are prohibited from entering or<br />

remaining upon park property.<br />

§ 158-6. Enforcement. [Amended 5-9-1989 by L.L. No. 6-1989]<br />

The Commissioner, <strong>County</strong> security and other agents designated by the Commissioner (in<br />

addition to local, <strong>County</strong> or state police or other law enforcement officers), are hereby<br />

authorized to, and they shall, enforce the foregoing rules and regulations, which power shall<br />

include but not be limited to the power to issue appearance tickets and to exercise such other<br />

legal methods of enforcement of the foregoing rules and regulations as the Commissioner or<br />

his agents may deem appropriate and necessary.<br />
