§ 158-3 BROOME COUNTY CHA<strong>RT</strong>ER AND CODE<br />

§ 158-3<br />

(1) No person shall commit, perform or engage in any lewd, lascivious, obscene or<br />

indecent act or behavior.<br />

(2) No person shall display any appearance which would normally be considered<br />

topless or bottomless or nude.<br />

(3) Any state of undress sufficient to cause disorderly conduct is prohibited.<br />

G. Unlawful assembly.<br />

(1) No person shall assemble with four or more other persons for the purpose of<br />

engaging or preparing to engage with them in tumultuous and violent conduct<br />

likely to cause public alarm or when, being present at an assembly which either<br />

has or develops such purpose, he remains there with intent to advance that<br />

purpose.<br />

H. Loitering.<br />

(1) No person shall loiter in or near toilets or rest room facilities within the park.<br />

I. Alcoholic beverages; intoxicants. [Amended 4-19-1983 by L.L. No. 6-1983]<br />

(1) No person other than responsible individuals shall be in possession of beer or<br />

alcoholic beverages, in accordance with state statutes. The Commissioner shall<br />

eject from the park those persons who, at the sole discretion of the Commissioner,<br />

are abusing the privilege.<br />

(2) No person shall use or have in his or her possession any drugs, as defined in the<br />

Penal Law of the State of New York, unless they have been prescribed by a<br />

physician for the possessor or are legally available without prescription to the<br />

public.<br />

(3) Upon approval of the appropriate Committee of the Legislature, the consumption<br />

of beer or alcoholic beverages may be prohibited in certain areas, as designated by<br />

the Commissioner, where such use may have significant adverse effects on<br />

facilities, programs or individuals participating in programs offered by the<br />

Department. Despite any prohibition imposed pursuant to this section, the<br />

consumption of beer or alcoholic beverages may be allowed in such areas as part<br />

of fundraising events on behalf of charitable organizations, upon the prior approval<br />

of the appropriate Legislative Committee. [Amended 6-22-1983 by L.L. No.<br />

J. Advertising, signs and commercial enterprises.<br />

(1) No person shall distribute or place any sign, advertisement, circular, notice,<br />

statement, banner, emblem or design without written permission from the<br />

Commissioner.<br />

(2) No person shall beg, hawk, peddle or solicit within the park or leisure facility.<br />
