§ 60-2 BROOME COUNTY CODE § 60-5<br />

§ 60-2. Granting of assistance authorized.<br />

The <strong>Broome</strong> <strong>County</strong> Sheriff, or, during his absence, illness or disability, the individual in<br />

command who is authorized to exercise the powers of the Sheriff in emergency situations, is<br />

hereby authorized and empowered to grant requests for police assistance, as set forth in<br />

§ 60-1, made by the Chief Executive Officer of any local government or by the individual<br />

duly authorized to make such a request.<br />

§ 60-3. Liabilities.<br />

Liability for expenses or damages incurred in rendering assistance pursuant to this Article<br />

shall be established by mutual agreement, in writing, between the municipality giving and the<br />

municipality receiving such assistance.<br />

Sheriff's Benefits<br />

§ 60-4. Findings and intent; procedure.<br />

A. The <strong>Broome</strong> <strong>County</strong> Legislature hereby finds and declares that § 207-c of the General<br />

Municipal Law which provides wage and medical benefits for Sheriff's deputies and<br />

correction officers injured in the performance of their duties has been difficult to<br />

administer because of the lack of guidelines in the statute.<br />

B. This Article is being enacted to provide the county with a simple, workable procedure to<br />

regulate the application for and the award of benefits under § 207-c of the General<br />

Municipal Law. This Article creates procedures that will ensure a fair and equitable<br />

administration of benefits. This Article protects the rights of <strong>Broome</strong> <strong>County</strong> and the<br />

Sheriff, as well as those of the employees of the county employed as Undersheriff,<br />

Sheriff's deputies and correction officers.<br />

C. The procedure provided by this Article shall be the exclusive method used in<br />

administering the aforesaid benefits for <strong>Broome</strong> <strong>County</strong>. It has been enacted pursuant to<br />

§ 207-c of the General Municipal Law.<br />

§ 60-5. Definitions.<br />

As used in this Article, the following terms shall have the meanings indicated:<br />

DEPUTY —<br />

<strong>County</strong>.<br />

The Sheriff, Undersheriff, Sheriff's deputies or correction officers of <strong>Broome</strong><br />

LIGHT DUTY — Those regular duties which a deputy is capable of performing.<br />

REGULAR DUTY — Those duties which a deputy sheriff or corrections officer may be<br />

called upon to perform in the regular course of his employment.<br />
