§ 158-2 BROOME COUNTY CHA<strong>RT</strong>ER AND CODE<br />

PARK — Any and all land and/or physical structures owned or controlled by the <strong>County</strong> of<br />

<strong>Broome</strong> and administered by its Department of Parks and Recreation. These shall include<br />

areas designated as parks, campgrounds, picnic areas, ice rinks, nature reserves, the Arena,<br />

Forum and other special use areas as designated by the Department of Parks and Recreation.<br />

PERSON — Includes persons and corporations and other groups.<br />

§ 158-3. Rules, regulations and prohibitions.<br />

Rules and regulations for the conduct of persons entering upon parks operated by <strong>Broome</strong><br />

<strong>County</strong> shall be as follows:<br />

A. Preservation of property, natural resources.<br />

(1) No person shall injure, deface, destroy, disturb, remove or misuse any part of the<br />

park nor any building, sign, equipment or other property.<br />

(2) No person shall operate a chain saw within the park.<br />

B. Disposal of rubbish, garbage, sewage and noxious materials.<br />

(1) No person shall leave behind or dump any material of any kind in the park except<br />

the refuse, ashes, garbage and other material of a picnic, camp or other permitted<br />

activity, and such material shall be deposited in receptacles provided for such<br />

purposes.<br />

(2) No person shall, within the park, place or permit to be placed in any river, brook,<br />

stream, ditch or drain any liquid or aqueous waste which shall fail to comply with<br />

the minimum requirements as set by the New York State Department of Health for<br />

Quality Standard for Class B Waters.<br />

C. Weapons and explosives.<br />

(1) No person except duly authorized employees of the Department or law<br />

enforcement officers shall use, carry or possess any firearm within the park.<br />

Persons are authorized to carry firearms within the park in designated hunting<br />

areas, provided that they are actually hunting, in accordance with the New York<br />

State laws and regulations.<br />

(2) No person except law enforcement officers shall use, carry or possess any noxious<br />

materials ("noxious materials," for purposes of this section, shall be defined as<br />

irritant gas dispensers, commonly called "tear gas or "mace") within the park.<br />

(3) No person shall use, carry or possess air or gas guns, slingshots, bows and arrows,<br />

missiles or missile-throwing devices, unless such person is a participant in a<br />

program sponsored by the Department which uses such items for recreational<br />

purposes only.<br />
