B. No persons shall discharge any sewage or sewage effluent into any watercourse or<br />

surface body of water in the <strong>Broome</strong> <strong>County</strong> Health District unless a permit therefor has<br />

been issued under the provisions of the Public Health Law or State Sanitary Code for<br />

such discharge, and such discharge shall be made in accordance with the requirements<br />

thereof.<br />

C. Any person who is engaged, in whole or in part, in the business of selling, constructing,<br />

maintaining, installing or cleaning septic tanks or private sewage disposal systems shall<br />

register that fact with the Department of Health. Such registration shall be on a form<br />

prescribed and furnished by the Commissioner. Reregistration may be required from time<br />

to time by the Commissioner or his representative, and such reregistration shall be when<br />

requested by the Commissioner or his representative. Any person who fails or refuses to<br />

so register shall be in violation of the Sanitary Code and shall be subject to the penalties<br />

set forth in § 168-41 of this code.<br />

D. Any person engaged in the business of water well drilling and/or water hauling for<br />

human consumption shall register that fact with the Department of Health. Such<br />

registration shall be made on a form prescribed and furnished by the Commissioner.<br />

Reregistration may be required from time to time by the Commissioner or his<br />

representative, and such reregistration shall be when requested by the Commissioner or<br />

his representative. Any person who fails or refuses to so register shall be in violation of<br />

the Sanitary Code and shall be subject to the penalties set forth in § 168-41 of this code.<br />

§ 168-16. Approval required for sewage disposal systems.<br />

A. No person, either as owner or agent thereof, or lessee or tenant, shall undertake to<br />

construct or provide a system or facilities for the private disposal of waterborne sewage,<br />

domestic or trade wastes to serve any dwelling, school, institution or premises from<br />

which such wastes may be discharged without first having obtained preliminary approval<br />

of the proposed sewage facilities upon forms furnished by the Commissioner and upon a<br />

determination by the Commissioner that said proposed sewage facilities will be adequate<br />

to serve the sewage disposal needs of the premises.<br />

B. The owner or his agent or the lessee or tenant who shall be in responsible charge of any<br />

dwelling, school, institution or premises for which a preliminary approval has been<br />

obtained shall have the system, when completed, left uncovered for inspection by a<br />

representative of the <strong>Broome</strong> <strong>County</strong> Health Department and/or Municipal Building<br />

Inspector, provided that said Inspector is approved by the Commissioner, who shall make<br />

final inspection and give final approval before backfilling and covering is carried out. If<br />

backfilling has been completed before final inspection, the owner or his agent will be<br />

required to have the work uncovered to permit such inspection. [Amended 4-4-1991 by<br />

C. A copy of the preliminary approval shall be issued by the <strong>Broome</strong> <strong>County</strong> Health<br />

Department and shall be supplied to the Town Planning Board or other municipal agency<br />

charged with the responsibility of issuing building permits and to the owner or his agent.<br />
