§ A2305-A BROOME COUNTY ADMINISTRATIVE CODE § A2306-A<br />

§ A2305-A. Personnel. [Amended 9-21-1990 by L.L. No. 10-1990]<br />

(A) The Personnel Office of <strong>Broome</strong> <strong>County</strong> shall continue to provide civil service<br />

examinations, updated eligible lists for positions at the college, certification of<br />

appointments as being in compliance with Civil Service Law and certification of payrolls<br />

for compliance with the Civil Service Law, arrange medical examinations for those<br />

positions which require medical examination prior to appointment and provide such other<br />

services as are provided to the various civil service jurisdictions within the <strong>County</strong>.<br />

(B) The Personnel Office of the college shall, with approval of the Board of Trustees,<br />

prepare and identify all minimum salary grades for all positions at the college.<br />

(C) In all other respects the Board of Trustees and the administration of <strong>Broome</strong> Community<br />

College shall be directly responsible for all personnel matters, including but not limited<br />

to compliance with all civil service laws and employment laws under the Charter, state<br />

laws, federal laws and local laws.<br />

The Board of Trustees of <strong>Broome</strong> <strong>County</strong> Community College shall negotiate all labor<br />

contracts on behalf of the college. [Amended 2-21-1991 by L.L. No. 7-1991]<br />

All negotiated employee benefits.<br />

(A) The Board of Trustees shall have the authority to establish policies concerning the<br />

review of all qualifications for candidates for employment and provide the proper<br />

orientation for any candidate selected. It shall have the authority to hire above the<br />

minimum, promote, hire temporaries, institute hiring freezes and fix compensation for<br />

all nonrepresented employees. The Board's right to fix compensation for<br />

nonrepresented employees shall be limited to a percentage equal to the average<br />

increase for the faculty and guild in the fiscal year. A salary increase for<br />

nonrepresented employees in excess of this percentage must be approved by the<br />

<strong>County</strong> Legislature. The Board shall authorize all policies of leave, sabbaticals and<br />

travel on behalf of the college.<br />

(B) On a monthly basis, the Board of Trustees shall cause to be filed a report with the<br />

<strong>Broome</strong> <strong>County</strong> Executive and the Clerk of the Legislature, detailing what budgetary<br />

transfers were made in the preceding month, along with what positions were filled at<br />

salaries exceeding the minimum for those positions and any further monthly<br />

information deemed required by the <strong>County</strong> Legislature or the <strong>County</strong> Executive so as<br />

to appropriately monitor the financial operations of <strong>Broome</strong> Community College.<br />

§ A2306-A. Board of Acquisition and Contract.<br />

1. There shall be created a Board of Acquisition and Contract for the college, which shall<br />

consist of the Board of Trustees' Finance and Facilities Committee. The Board shall<br />

award all contracts involving the college, provided that said contracts are approved, in<br />

writing, as to form by the <strong>County</strong> Attorney.<br />

2. This Board shall not have authority to award contracts which provide for the payment of<br />

moneys not contained in the college budget or in the capital programs budget.<br />
