§ 48-1. Records Management Officer; staff; expenses.<br />

There shall be a Records Management Officer who shall be responsible for administering<br />

noncurrent and archival public records in accordance with local, state and federal law and<br />

guidelines promulgated attendant thereto. The <strong>Broome</strong> <strong>County</strong> Clerk shall serve as Records<br />

Management Officer. Within the appropriations provided therefor, the <strong>County</strong> Clerk shall<br />

appoint such staff and incur such expenses as may be necessary for the proper execution of<br />

the functions and powers of the Records Management Officer.<br />

§ 48-2. Powers and duties of Records Management Officer. [Added 6-22-1989 by L.L.<br />

No. 8-1989]<br />

A. The Records Management Officer shall have all necessary powers to carry out the<br />

efficient administration, determination of value, use, preservation, security and<br />

disposition of noncurrent and archival public records. The determination of value, use,<br />

preservation and disposition of records by the Records Management Officer may only be<br />

made after consultation with and agreement by the appropriate department head or<br />

designee. Conversely, no records shall be destroyed or otherwise disposed of by a<br />

department unless approval has been obtained from the Records Management Officer.<br />

B. The Records Management Officer shall:<br />

(1) Survey public records to determine whether the records may be classified as:<br />

obsolete and unnecessary according to New York State Records Retention and<br />

Disposition Schedules, thereby subject to disposition; or containing information of<br />

administrative, legal, fiscal, research, historical or educational value which<br />

warrants their permanent retention; or records not subject to disposition according<br />

to state law, and take all the necessary action to effectuate the functions of the<br />

Office.<br />
