• Up until recently, three <strong>de</strong>partments were sharing responsibility for the management<br />

of regulatory quality policies, specifically the Department for Economic Affairs,<br />

the Department of Environment and the Department of Justice. Do they still share<br />

responsibility for regulatory quality policies? Also for RIA? Is the Proposed Legislation<br />

Desk still managed by the 3 ministries? Has the overall responsibility for RIA<br />

moved to the Department of Economic Affairs?<br />

• How many people works at the Proposed Legislation Desk?<br />

• Which are their aca<strong>de</strong>mic backgrounds?<br />

• How is it structured (<strong>de</strong>partments)?<br />

• What’s its budget?<br />

• The Ministry of Economic Affairs is in charge of the revision regarding the Business<br />

Impact Assessment, is there a person in the ministry in charge of the revisions?<br />

• The Ministry of Housing, Spatial Planning and the Environment is in charge of the<br />

revision regarding the Environmental Impact Checklist, do they have a person in<br />

charge of the revision?<br />

• Centre of expertise in enforcement. What is it exactly? Does it belong to the<br />

Ministry of Justice?<br />

• Capacity-building of <strong>de</strong>partment officials. Public (other actors involved):<br />

– How do <strong>de</strong>partment officials know how to i<strong>de</strong>ntify actors?<br />

– How do <strong>de</strong>partment officials know what are the alternatives to regulation? (is it<br />

inclu<strong>de</strong>d in the capacity-building, do they use consultation?).<br />

• When do public consultations take place?<br />

• Who selects the actors? (policy-maker, <strong>de</strong>partment official)<br />

• Which type of actors participate? Which non-governmental actors usually participate?<br />

• Which actors should be involved apart from the ones already involved? Why don’t<br />

they participate? Do citizens participate in the process?<br />

• Do they use any techniques to motivate actors? Capacity-building of other actors<br />

involved in the process (citizens, etc.)<br />

• Are there official gui<strong>de</strong>lines for consultation?<br />

• vIs consultation compulsory? (Take into consi<strong>de</strong>ration that the RIA is not public during<br />

the consultation phase but when the draft legislation is sent to Parliament)<br />

• Duration of the consultation process (is there a established period of time for<br />

consultation?)<br />

• Is it compulsory to take into consi<strong>de</strong>ration the results of consultations?<br />

• Perceived weak and strong points of the process.
