which a limited class of persons imposed absolute trust having reason to believe in<br />
their unqualified reliability. As such they took on the attributes of a product and<br />
are not protected by the first amendment.<br />

The charts, as produced by Jeppesen (gedaagde, M.S.) and supplied to Wahlund<br />

without any individual tailoring or substantial change in contents -- they were<br />
simply mass-produced. The comments to @ 402A, supra, envision strict liability<br />
against sellers of such items in these circumstances. By publishing and selling the<br />
charts, Jeppesen undertook a special responsibility, as seller, to insure that<br />
consumers will not be injured by the use of the charts; Jeppesen is entitled -- and<br />
encouraged -- to treat the burden of accidental injury as a cost of production to be<br />
covered by liability insurance. ... This special responsibility lies upon Jeppesen in<br />
its role as designer, seller and manufacturer. ... Though a "product" may not<br />
include mere provision of architectural design plans or any similar form of data<br />
supplied under individually-tailored service arrangements, ... the mass production<br />
and marketing of these charts requires Jeppesen to bear the costs of accidents<br />
that are proximately caused by defects in the charts.<br />
8.2.13 Met andere woorden, om rechtspolitieke redenen is het gewenst dat op massaproducenten<br />
een regime van strict liability rust voor schade tengevolge van produktgebreken en die<br />
redenen gaan in het geval van Jeppesen op. Opvallend is dat de logica die ten aanzien van<br />
produkten (in het algemeen fysieke objecten) wordt gehanteerd omgekeerd is aan die die<br />
in het kader van negligent misrepresentations voor informatie wordt gebruikt. Bij<br />
produkten is de massa-produktie reden voor het aannemen van aansprakelijkheid, bij<br />
informatie is juist een 'special relationship' voorwaarde voor aansprakelijkheid.<br />
8.2.14 In Brocklesby v. United States wordt overwogen dat als een handelsblad de instrument<br />
approach procedure van de overheid in tekstvorm had gepubliceerd en een piloot zou de<br />
procedure uit het handelsblad gebruikt hebben, dan zou het handelsblad immuun zijn voor<br />
‘strict liability’. Het geval van Jeppesen verschilde hier echter van: Jeppesen's charts are<br />
more than just a republication of the text of the government's procedures. Jeppesen<br />
converts a government procedure from text into graphic form and represents that the<br />
chart contains all necessary information.' Dit laatste lijkt een beetje te wijzen in de<br />
richting van een ‘garantie’ van Jeppesen. Jeppesen brengt de kaarten in een vorm die hen<br />
bij uitstek geschikt maken voor een bepaald gebruik en brengt dit feit in de<br />
presentatie/marketing van de kaarten naar voren. Daarmee wordt een soort ‘garantie’ van<br />
correctheid, volledigheid of geschiktheid voor een bepaald gebruik gegeven die bij<br />
‘normale’ publicaties niet aanwezig lijkt te zijn.<br />
