L<strong>and</strong> <strong>and</strong> forest disputes between the communities on the one h<strong>and</strong>, <strong>and</strong> the government,<br />

logg<strong>in</strong>g concessionaires <strong>and</strong> licensee on the other h<strong>and</strong>, are serious especially<br />

<strong>in</strong> Sarawak where there are greater number of communities liv<strong>in</strong>g <strong>in</strong> the forests<br />

(Malaysian NGOs Position statement, October 1999). Workshops on Community<br />

Consultations on <strong>Forest</strong> <strong>Certification</strong> (February-April 2001) proposed that the way to<br />

accord legal recognition <strong>and</strong> protection to native customary rights (NCR) over l<strong>and</strong><br />

for the Sarawak <strong>in</strong>digenous peoples is to amend the laws on l<strong>and</strong>, <strong>in</strong> particular<br />

Section 5 of the Sarawak L<strong>and</strong> Code.<br />

The concern is about the full recognition of NCR over l<strong>and</strong> of the Orang Asli of<br />

Sarawak as well as Sabah <strong>and</strong> Pen<strong>in</strong>sular Malaysia, <strong>in</strong> accordance with the native laws<br />

<strong>and</strong> customary practice of the particular native community occupy<strong>in</strong>g that l<strong>and</strong> <strong>and</strong><br />

that native customary rights over l<strong>and</strong> shall not be ext<strong>in</strong>guished or term<strong>in</strong>ated without<br />

the consent of the natives or unless the natives have voluntarily surrendered, after<br />

full <strong>in</strong>formation, such rights.<br />

Lack of Consensus<br />

The formation of a Multi-Stakeholder National Work<strong>in</strong>g Group <strong>in</strong>to three or four<br />

different sectors is not work<strong>in</strong>g well s<strong>in</strong>ce they are not work<strong>in</strong>g towards a common<br />

goal of SFM but <strong>in</strong>stead promot<strong>in</strong>g their own <strong>in</strong>terest. There has been no consensus<br />

on proceed<strong>in</strong>g with four “chambers” <strong>in</strong>volv<strong>in</strong>g representatives from social, environment,<br />

economic <strong>and</strong> direct resource manager <strong>in</strong>terests. Yet the MTCC <strong>and</strong> NSC are<br />

currently proceed<strong>in</strong>g along this path. This is a source of major disagreement.<br />

There is also a rift between the aspirations of members of the Social Group. The<br />

potential for the Social Group to reach consensus is difficult as the workers’ union has<br />

conflict<strong>in</strong>g <strong>in</strong>terest with community organizations with<strong>in</strong> the group. Accord<strong>in</strong>g to the<br />

NGOs, the union representatives have demonstrated <strong>in</strong>flexibility <strong>and</strong> lack of<br />

openness to <strong>in</strong>digenous peoples’ concerns. To make matters worse, representatives of<br />

community organizations question the union’s legitimacy to be with<strong>in</strong> this group <strong>and</strong><br />

thus need clarification on their position <strong>and</strong> <strong>in</strong>terests.<br />

FSC Endorsement<br />

Malaysia through the NTCC approached the FSC as early as 1999 to work together on<br />

timber certification. FSC does not support mutual recognition of MC&I. Instead<br />

Malaysia has to adapt its P&Cs to obta<strong>in</strong> FSC endorsement/certification.<br />

Further, FSC has several reservations with the MC&I for SFM (Synnott, quoted <strong>in</strong><br />

Gilley 2000). These reservations particularly <strong>in</strong>clude two po<strong>in</strong>ts (Gilley 2000):<br />

Rights for workers <strong>and</strong> <strong>in</strong>digenous peoples;<br />

Better forest management.<br />

The rights of workers <strong>and</strong> <strong>in</strong>digenous peoples is a foundation of the<br />
