Structural Features<br />

Ownership <strong>and</strong> Tenure<br />

The current l<strong>and</strong> tenure regime <strong>in</strong> Latvia was established after the country ga<strong>in</strong>ed<br />

<strong>in</strong>dependence from the Soviet Union <strong>in</strong> 1991. One of the priorities of the new<br />

Republic was to restore pre-1945 property rights by return<strong>in</strong>g l<strong>and</strong> to its previous<br />

owners or their next of k<strong>in</strong>. The purpose of l<strong>and</strong> restitution was to restructure the<br />

legal, social <strong>and</strong> economic aspects of l<strong>and</strong> use <strong>and</strong> property <strong>in</strong> the Latvian<br />

countryside, <strong>in</strong> order to renew the traditional Latvian rural lifestyle. This large-scale<br />

process created 164,232 private l<strong>and</strong>owners with an average parcel size of eight<br />

hectares (Pelane 2000). Together, private l<strong>and</strong>owners own just less than one-half of<br />

Latvia’s forestl<strong>and</strong>.<br />

This highly fragmented l<strong>and</strong> ownership structure might turn out to have<br />

important implications with respect to forest certification on private l<strong>and</strong>s. Because<br />

of the small average parcel size, many forest owners do not receive significant regular<br />

<strong>in</strong>come from their forest hold<strong>in</strong>gs, <strong>and</strong> the certification process requires a significant<br />

f<strong>in</strong>ancial <strong>in</strong>vestment. In addition, there is no market dem<strong>and</strong> for certified wood<br />

with<strong>in</strong> Latvia. There is approximately twice as much timber process<strong>in</strong>g capacity (i.e.<br />

sawmills) <strong>in</strong> Latvia, as there is supply of raw lumber. Therefore, the small forest owner<br />

who might harvest some wood for supplemental <strong>in</strong>come generally has no difficulty<br />

f<strong>in</strong>d<strong>in</strong>g a local timber buyer who does not dem<strong>and</strong> certification.<br />

The forest sector <strong>in</strong> Latvia is poorly organized. Accord<strong>in</strong>g to the Latvian <strong>Forest</strong><br />

<strong>Certification</strong> Council (LFCC 2001), not more than five percent of forest sector enterprises<br />

are members of trade associations. Similarly, not more than five percent of private<br />

forest owners are members of the <strong>Forest</strong> Owners’ Association – Latvia’s only<br />

such organization. There is only one forest sector trade union, which has 5,000 members,<br />

out of an estimated total of 50,000 employees <strong>in</strong> forest-related jobs <strong>in</strong> Latvia<br />

(WWF Latvia 2003).<br />
