that a regional certification system be developed, the declaration strongly <strong>in</strong>fluences<br />

the forestry adm<strong>in</strong>istration <strong>in</strong> Gabon, which signalled its support for the idea of<br />

forest certification <strong>and</strong> committed resources to development of a certification<br />

st<strong>and</strong>ard <strong>and</strong> capacity build<strong>in</strong>g. (It is worth not<strong>in</strong>g that the Yaoundé Summit was<br />

partly <strong>in</strong>itiated by WWF, which may have <strong>in</strong>fluenced the declaration’s attention to<br />

forest certification).<br />

Institutional Design<br />

Institutional design varies across the two forest certification systems that operate <strong>in</strong><br />

Gabon, the FSC <strong>and</strong> the Dutch Keurhout system. The African Timber Organization<br />

(ATO) undertook a feasibility study to set up a regional certification system <strong>in</strong> Africa<br />

<strong>in</strong> 2003 (<strong>in</strong>clud<strong>in</strong>g Gabon) to be called Pan African <strong>Forest</strong> <strong>Certification</strong> (PAFC), but<br />

as of the w<strong>in</strong>ter of 2005 the <strong>in</strong>stitutional sett<strong>in</strong>g of PAFC <strong>in</strong> Gabon were still be<strong>in</strong>g<br />

f<strong>in</strong>alised.<br />

The <strong>in</strong>stitutional processes with<strong>in</strong> the FSC (<strong>and</strong> to a lesser extent Keurhout) can<br />

be dist<strong>in</strong>guished by their <strong>in</strong>ternational frameworks, their domestic processes, <strong>and</strong><br />

their appeals functions.<br />

At the <strong>in</strong>ternational level, both the FSC <strong>and</strong> Keurhout have procedures established<br />

outside Gabon that establish governance structures <strong>and</strong> broad pr<strong>in</strong>ciples <strong>and</strong> criteria<br />

to which all countries must adhere. The FSC, as noted <strong>in</strong> the <strong>in</strong>troduction to this<br />

book, has created 10 pr<strong>in</strong>ciples <strong>and</strong> criteria govern<strong>in</strong>g a range of globally important<br />

forestry issues <strong>in</strong>clud<strong>in</strong>g <strong>in</strong>digenous rights, susta<strong>in</strong>able forest management,<br />

community <strong>in</strong>volvement, <strong>and</strong> so on.<br />

The FSC requires that a national work<strong>in</strong>g group develop specific <strong>in</strong>dicators <strong>and</strong><br />

verifiers <strong>in</strong> accordance with the 10 pr<strong>in</strong>ciples <strong>and</strong> criteria. The FSC does not require<br />

that a national work<strong>in</strong>g group vote accord<strong>in</strong>g to the one-third format of the<br />

<strong>in</strong>ternational body, leav<strong>in</strong>g much rule-mak<strong>in</strong>g discretion to domestic FSC national<br />

work<strong>in</strong>g group participants. The FSC does require, however, that half the members of<br />

a national work<strong>in</strong>g group be FSC members. Gabon’s current work<strong>in</strong>g group falls far<br />

short of this requirement, which partly expla<strong>in</strong>s why they have not sought FSC<br />

approval.<br />

In the absence of formally approved st<strong>and</strong>ards developed by national work<strong>in</strong>g<br />

groups, the FSC provides for a provisional process <strong>in</strong> which an audit<strong>in</strong>g company<br />

develops temporary st<strong>and</strong>ards. These temporary st<strong>and</strong>ards tend not to follow the<br />

same type of open consultation process <strong>and</strong> limit local participation. It was these very<br />

dynamics that led to the controversy surround<strong>in</strong>g Leroy-Gabon (discussed below),<br />

where concerned national <strong>and</strong> local actors were not part of the process that led to its<br />

certification. Keurhout’s domestic process is very limited — other than logg<strong>in</strong>g<br />

enterprises, there is limited public participation over issu<strong>in</strong>g of Keurhout certificates.<br />

Both the FSC <strong>and</strong> Keurhout systems require that the decision to issue a certificate<br />

be made <strong>in</strong> a transparent fashion. Reports of the assessment <strong>and</strong> monitor<strong>in</strong>g missions<br />

must be made available to the general public <strong>and</strong> <strong>in</strong>terested parties are permitted to<br />

provide comments. Both the Keurhout Foundation <strong>and</strong> FSC have established an<br />

appeal panel for those who oppose the grant<strong>in</strong>g of a certificate. Such processes<br />
