By July 2001 the first audit of an LVM forest was carried out by the FSC-accredited<br />

certification company SGS Qualifor. The first forest management district was awarded<br />

an FSC certificate <strong>in</strong> September 2001, <strong>and</strong> by the follow<strong>in</strong>g April, one-half of LVM<br />

forests were certified. The first supervisory visits <strong>and</strong> audits were conducted then as well,<br />

with the rema<strong>in</strong><strong>in</strong>g audits completed <strong>in</strong> November 2002, aga<strong>in</strong> by SGS Qualifor, as well<br />

as by SmartWood. In January 2003 LVM announced that 100 percent of its forests had<br />

been certified under FSC. These certificates are valid for 5 years, dur<strong>in</strong>g which<br />

supervision visits will be carried out by the certification company once or twice a year.<br />

Institutional Design<br />

Latvian <strong>Forest</strong> Legislation<br />

Latvian legislation regulates all aspects of forest management, <strong>in</strong>clud<strong>in</strong>g management<br />

<strong>and</strong> documentation; forest management itself (timber fell<strong>in</strong>g permits, logg<strong>in</strong>g regulations<br />

based on type of logg<strong>in</strong>g activity, st<strong>and</strong> size, tree age <strong>and</strong> diameter, <strong>and</strong> environmental<br />

considerations; forest regeneration species <strong>and</strong> timel<strong>in</strong>es); social rights<br />

<strong>and</strong> guarantees (professional competence, worker safety, forest access <strong>and</strong> non-timber<br />

forest products); <strong>and</strong> environmental protection (protected area designation, environmental<br />

impact assessments dur<strong>in</strong>g management plann<strong>in</strong>g <strong>and</strong> execution).<br />

<strong>Forest</strong> legislation has been <strong>in</strong> a cont<strong>in</strong>uous process of evolution <strong>and</strong> reform s<strong>in</strong>ce<br />

Latvia’s restoration of <strong>in</strong>dependence, <strong>and</strong> as a result the entire forest sector has been<br />

<strong>in</strong> a dynamic <strong>and</strong> constant state of flux. In 1992 the <strong>Forest</strong>ry Department <strong>and</strong> Cab<strong>in</strong>et<br />

developed an <strong>in</strong>itial <strong>Forest</strong>ry Development Program to assess the development<br />

potential of the forest sector <strong>in</strong> Latvia. Then <strong>in</strong> 1995 the State <strong>Forest</strong> Service, with the<br />

assistance of the Swedish consult<strong>in</strong>g firm “Swedforest International AB” drafted the<br />

“Latvian <strong>Forest</strong> <strong>and</strong> Timber Industry Development Program.”<br />

The purpose of this document was to provide direction for the development of the<br />

forest <strong>in</strong>dustry. Although the Program did not develop specific activities or sources of<br />

fund<strong>in</strong>g <strong>in</strong> order to implement the recommended developments, some of the document’s<br />

recommendations have already been implemented. These achievements<br />

<strong>in</strong>clude an <strong>in</strong>ventory of sawmill production, <strong>in</strong>troduction of the certification process,<br />

<strong>and</strong> plans for a pulp mill. There is no official government support or endorsement of<br />

forest certification per se.<br />

In 1996 the government began work on a national forest policy. Input for this document<br />

was solicited from governmental agencies, non-governmental agencies, <strong>and</strong><br />

various <strong>in</strong>terest groups. In 1998 the <strong>Forest</strong> Policy was ratified, <strong>and</strong> this policy has s<strong>in</strong>ce<br />

served as the foundation for major legislation <strong>and</strong> overall development with<strong>in</strong> the<br />

forest sector. The major pieces of legislation developed as a result <strong>in</strong>clude:<br />

The Law on the State <strong>Forest</strong> Service (1999)<br />

The Law on <strong>Forest</strong>s (2000)<br />

The Law on Environmental Impact Assessments (1998)<br />

Currently the government is work<strong>in</strong>g to exp<strong>and</strong> the forest policy to <strong>in</strong>clude the<br />

entire array of forest sector <strong>in</strong>terests, as shown <strong>in</strong> Figure 4 (www.zm.gov.lv).<br />
