A request that the chair or facilitator of the National Steer<strong>in</strong>g Committee,<br />

Regional <strong>and</strong> National Consultations sessions, <strong>and</strong> associated meet<strong>in</strong>gs be<br />

an <strong>in</strong>dependent person to allow for balanced <strong>and</strong> neutral participation;<br />

A request for fund<strong>in</strong>g to facilitate travel <strong>and</strong> adm<strong>in</strong>istration to ensure a<br />

wider participation by <strong>in</strong>digenous people <strong>and</strong> NGOs.<br />

Ow<strong>in</strong>g to the <strong>in</strong>ability of the MTCC certification scheme to meet their dem<strong>and</strong>s,<br />

<strong>in</strong>digenous people fear that their tribal l<strong>and</strong>s may be signed off to logg<strong>in</strong>g concessions<br />

without their consent. They want their right to prior <strong>in</strong>formed consent <strong>and</strong> to be able<br />

to use their customary laws. To them ‘prior <strong>in</strong>formed consent’ means be<strong>in</strong>g told–with<br />

consent obta<strong>in</strong>ed – before national governments move <strong>in</strong> to del<strong>in</strong>eate protected areas<br />

around sacred l<strong>and</strong>s. They feel that they must do whatever is necessary to protect<br />

their resources at the local level, as they are not go<strong>in</strong>g to be recognised at the state,<br />

national or <strong>in</strong>ternational level. The modern laws <strong>and</strong> compet<strong>in</strong>g private sector <strong>in</strong>terests<br />

are alien to their traditional ways (Loh 2004a, 2004b)<br />

<strong>Forest</strong> Owners<br />

PITC, whose <strong>in</strong>terests are to produce certified timber that is accepted <strong>in</strong>ternationally,<br />

have begun to seek additional certification other than MTCC. FSC program seems to<br />

be alternative certification program be<strong>in</strong>g sought after. PITC is also seek<strong>in</strong>g ISO<br />

14000 environmental management system st<strong>and</strong>ards.<br />

NGOs<br />

Despite the encourag<strong>in</strong>g <strong>in</strong>terest shown by the Malaysian Government <strong>and</strong> Malaysian<br />

companies <strong>in</strong> certification, NGOs reception is less encourag<strong>in</strong>g. Environmental <strong>and</strong><br />

social NGOs <strong>and</strong> community-based groups <strong>in</strong> Malaysia <strong>and</strong> abroad have argued that<br />

the MTCC certified ‘susta<strong>in</strong>ably managed’ status of most of the states <strong>in</strong> Pen<strong>in</strong>sular<br />

Malaysia is not credible. The FSC certified concessions are exempted from this concern.<br />

Accord<strong>in</strong>g to WWF Malaysia (2003a), there are many different problems with the<br />

MTCC scheme, but the ma<strong>in</strong> concerns are:<br />

It does not give due recognition <strong>and</strong> acceptance of customary l<strong>and</strong> rights,<br />

tenures <strong>and</strong> user rights of <strong>in</strong>digenous peoples <strong>and</strong> local forest communities;<br />

It was not developed through a due consultation process, <strong>and</strong> emphasizes<br />

economic considerations while fail<strong>in</strong>g to adequately safeguard social values<br />

<strong>and</strong> environmental conservation.<br />

Because of the stalemate <strong>in</strong> gett<strong>in</strong>g recognition of FSC for MC&I, the Sarawak Timber<br />

Association (STA) began work<strong>in</strong>g on an <strong>in</strong>itiative s<strong>in</strong>ce the middle of 2003 to generate<br />

an <strong>in</strong>terim cha<strong>in</strong>-of-custody verification scheme. This <strong>in</strong>itiative <strong>in</strong>volves plac<strong>in</strong>g a<br />

mark on the timber <strong>and</strong> timber products of Sarawak. This mark is tentatively called<br />

yale school of forestry & environmental studies
