mentionn~s h l'article 9, h la condition<br />

toutefois que cet avis sera r~guli~rement donn6<br />

au Ministre des Affaires Etrangres du pays<br />

requis.<br />

L'arrestation provisoire aura lieu dans les<br />

formes et suivant les r~gles 6tablies par la<br />

16gislation du pays requis ou en usage dans ce<br />

pays. Elle cessera d'ftre maintenue si, dans le<br />

d~lai d'un mois h par'tir du moment oh elle<br />

aura 6t6 effectu~e, le Gouvernement requis n'a<br />

pas reu par voie diplomatique une demande<br />

d'extradition accompagn~e de l'un des documents<br />

mentionnds h l'article 9 de la pr~sente<br />

convention.<br />

Article ii.<br />

Quand il y aura lieu h extradition, tous les<br />

objets provenant du crime ou du d~lit, ou pouvant<br />

servir de pi~ces h conviction, qui seront<br />

trouv~s en la possession de l'individu r~clam6<br />

au moment de son arrestation ou qui seront<br />

d~couverts ult~rieurement, seront remis h l'Etat<br />

requrant.<br />

Cette remise se fera mme si 'extradition<br />

ne peut s'accomplir par suite de l'6vasion ou de<br />

la mort de l'individu r~clam6.<br />

Sont cependant rdservds les droits que des<br />

tiers auraient pu acqudrir sur les dits objets<br />

qui devront, le cas 6chdant, leur tre rendus,<br />

sans frais, k la fin du proc~s.<br />

Article 12.<br />

Les frais d'arrestation, d'entretien et de<br />

transport de l'individu dont l'extradition aura<br />

6t6 accord6e, ainsi que ceux de consignation et<br />

de transport des objets qui, aux termes de<br />

l'article pr6cedent, doivent 6tre restitu~s ou<br />

remis, resteront h la charge des deux pays dans<br />

les limites de leurs territoires respectifs.<br />

Les frais de transport ou autres sur les territoires<br />

des Etats interm6diaires sont h la charge<br />

de 'Etat r6clamant.<br />

Les frais de transport ou autres par mer<br />

resteront 6galement h la charge de l'Etat r~clamant.<br />

L'individu h extrader sera conduit au port<br />

du pays requis, ou au point de la fronti~re que<br />

d~signera le Gouvernement rclamant.<br />

mentioned in Article 9 ; provided always that<br />

such notice shall be duly given to the Ministry<br />

for Foreign Affairs of the Country to which the<br />

request is addressed.<br />

A provisional arrest shall be made in conformity<br />

with the rules established by legislation<br />

or usage in the State to which the request for<br />

extradition is addressed. It will become void<br />

if, within one month from the arrest, the<br />

government to which the request is addressed,<br />

has not received through diplomatic channels<br />

a request for extradition accompanied by one<br />

of the documents mentioned in article 9 of the<br />

present Convention.<br />

Article ii.<br />

When extradition is granted, any objects<br />

connected with the crime, or delict, or serving<br />

as evidence for conviction, found in the possession<br />

of the person claimed at the moment of his<br />

arrest, or discovered later, will be sent to the<br />

State claiming extradition.<br />

These objects will be sent even if the extradition<br />

cannot be carried out on account of the<br />

escape or death of the person claimed.<br />

Rights acquired by third persons over such<br />

objects are not prejudiced and the objects<br />

shall in proper cases be returned to such persons<br />

free of cost, at the end of the proceedings.<br />

Article 12.<br />

The costs of arrest, maintenance and transport<br />

of an extradited person, as well as the<br />

costs of the safekeeping and transport of<br />

objects which, under the terms of the preceding<br />

Article must be delivered or restored, will<br />

be defrayed by the two countries concerned<br />

within the limits of their respective territories.<br />

Transport or other expenses within the<br />

territories of intermediate States shall be<br />

defrayed by the State requesting extradition.<br />

Transport or other costs at sea will be defrayed<br />

by the State requesting extradition.<br />

The person extradited will be conducted to<br />

such port of the country to which the claim<br />

is addressed, or to such point of its frontier,<br />

as may be specified by the Government making<br />

the claim.
