Tribunal, soit personnellement, soit par des
conseils, et le Tribunal aura le droit de demander
au rdclamant toutes explications et tous documents
ou argumentation compldmentaires qu'il
jugerait ndcessaires.
60 Avant d'entendre ]a cause, le Tribunal
devra requrir des parties un dp6t ou une
garantie de toute somme qu'il pourra juger
n6cessaire pour payer la part de chaque rdclamant
dans les d~penses du Tribunal. Pour en
fixer le montant, le Tribunal se basera principalement
sur l'6tendue du terrain revendiqu6.
11 pourra aussi demander aux parties un compldment
de d6p6t dans les affaires impliquant
des ddpenses spdcialcs.
70 Le chiffre des honoraires des arbitres sera
ddtermine par toois, et fix6 par les Gouvernements
intdressds. Le Prdsident fixera lcs appointements
du secrdtaire et de toutes autres personnes
employdes par le Tribunal.
80 Sous rdserve des stipulations de la pr6sente
Annexe, le Tribunal aura plein pouvoir
pour rdgler sa propre proc~dure.
90 Dans l'examen des revendications, le Tribunal
devra prendre en consid6ration :
a) Toutes r~gles applicables du droit
des gens -
b) les principes g~ndraux de justice
et d' quit6 :
c) les circonstances suivantes
i. la date h laquelle le terrain
revendiqud a R6 occup6 pour. la premiere
fois par le rdclamant on ses
auteurs ;
2. la date .4 laquelle la revendication
a 6t6 notifide an Gouvernement
du r~clamant ;
3. la mesure dans laquelle le
rfclamant ou ses auteurs ont ddvelopp6
et exploit6 le terrain revendiqu6 par
le rdclamant. A cet 6gard, le Tribunal
devra tenir compte des circonstances
ou des entraves qui, par suite de
l'existence de l'6tat de guerre de
1914 i 1919 ont pu emp&her les
r~clamants de poursuivre leur rclamation.
io o Toutes les d~penses du tribunal seront
partagdes entre les rtclamants dans la proportion
fixe par le Tribunal. Dans le cas oh le
montant des sommes d6pos6es selon les stipulations
de l'alin6a 60 viendrait h ddpasser celui
des frais du Tribunal, le solde en serait rembours6
aux personnes dont les rdclamations ont
6t6 admises, et cela dans la proportion jug~e
4quitable par le Tribunal.
in person or by counsel, and the Tribunal shall
be entitled to call upon the claimants to present
such additional explanations, documents or
arguments as it may think necessary.
(6) Before the hearing of any case the Tribunal
shall require from the parties a deposit or
security for such sum as it may think necessary
to cover the share of each party in the expenses
of the Tribunal. In fixing the amount of such
sum the Tribunal shall base itself principally
on the extent of the land claimed. The Tribunal
shall also have power to demand a further
deposit from the parties in cases where special
expense is involved.
(7) The honorarium of the arbitrators shall
be calculated per month, and fixed by the
Governments concerned. The salary of the
Secretary and any other persons omployed by
the Tribunal shall be fixed by the President.
(8) Subject to the provisions of this Annex
the Tribunal shall have full power to regulate
its own procedure.
(9) In dealing with the claims the Tribunal
shall take into consideration :
(a) any applicable rules of International
Law ;
(b) the general prineiples of justice
and equity ;
(c) the following circumstances
(i) the date on which the land
claimed was first occupied by the
claimant or his predecessors in title;
(ii) the date on which the claim
was notified to the Government of the
claimant ;
(iii) the extent to which the
claimant or his predecessors in title
have developped and exploited the
land claimed. In this connection the
Tribunal shall take into account the
extent to which the claimants may
have been prevented from developing
their undertakings by conditions or
restrictions resulting from the war of
1914-1919.
(io) All the expenses of the Tribunal shall
be divided among the claimants in such proportion
as the Tribunal shall decide. If the amount
of the sums paid in accordance with clause (6)
is larger than the expenses of the Tribunal,
the balance shall be returned to the parties
whose claims have been recognised in such
proportion as the Tribunal shall think fit.
