conseils, et le Tribunal aura le droit de demander<br />

au rdclamant toutes explications et tous documents<br />

ou argumentation compldmentaires qu'il<br />

jugerait ndcessaires.<br />

60 Avant d'entendre ]a cause, le Tribunal<br />

devra requrir des parties un dp6t ou une<br />

garantie de toute somme qu'il pourra juger<br />

n6cessaire pour payer la part de chaque rdclamant<br />

dans les d~penses du Tribunal. Pour en<br />

fixer le montant, le Tribunal se basera principalement<br />

sur l'6tendue du terrain revendiqu6.<br />

11 pourra aussi demander aux parties un compldment<br />

de d6p6t dans les affaires impliquant<br />

des ddpenses spdcialcs.<br />

70 Le chiffre des honoraires des arbitres sera<br />

ddtermine par toois, et fix6 par les Gouvernements<br />

intdressds. Le Prdsident fixera lcs appointements<br />

du secrdtaire et de toutes autres personnes<br />

employdes par le Tribunal.<br />

80 Sous rdserve des stipulations de la pr6sente<br />

Annexe, le Tribunal aura plein pouvoir<br />

pour rdgler sa propre proc~dure.<br />

90 Dans l'examen des revendications, le Tribunal<br />

devra prendre en consid6ration :<br />

a) Toutes r~gles applicables du droit<br />

des gens -<br />

b) les principes g~ndraux de justice<br />

et d' quit6 :<br />

c) les circonstances suivantes<br />

i. la date h laquelle le terrain<br />

revendiqud a R6 occup6 pour. la premiere<br />

fois par le rdclamant on ses<br />

auteurs ;<br />

2. la date .4 laquelle la revendication<br />

a 6t6 notifide an Gouvernement<br />

du r~clamant ;<br />

3. la mesure dans laquelle le<br />

rfclamant ou ses auteurs ont ddvelopp6<br />

et exploit6 le terrain revendiqu6 par<br />

le rdclamant. A cet 6gard, le Tribunal<br />

devra tenir compte des circonstances<br />

ou des entraves qui, par suite de<br />

l'existence de l'6tat de guerre de<br />

1914 i 1919 ont pu emp&her les<br />

r~clamants de poursuivre leur rclamation.<br />

io o Toutes les d~penses du tribunal seront<br />

partagdes entre les rtclamants dans la proportion<br />

fixe par le Tribunal. Dans le cas oh le<br />

montant des sommes d6pos6es selon les stipulations<br />

de l'alin6a 60 viendrait h ddpasser celui<br />

des frais du Tribunal, le solde en serait rembours6<br />

aux personnes dont les rdclamations ont<br />

6t6 admises, et cela dans la proportion jug~e<br />

4quitable par le Tribunal.<br />

in person or by counsel, and the Tribunal shall<br />

be entitled to call upon the claimants to present<br />

such additional explanations, documents or<br />

arguments as it may think necessary.<br />

(6) Before the hearing of any case the Tribunal<br />

shall require from the parties a deposit or<br />

security for such sum as it may think necessary<br />

to cover the share of each party in the expenses<br />

of the Tribunal. In fixing the amount of such<br />

sum the Tribunal shall base itself principally<br />

on the extent of the land claimed. The Tribunal<br />

shall also have power to demand a further<br />

deposit from the parties in cases where special<br />

expense is involved.<br />

(7) The honorarium of the arbitrators shall<br />

be calculated per month, and fixed by the<br />

Governments concerned. The salary of the<br />

Secretary and any other persons omployed by<br />

the Tribunal shall be fixed by the President.<br />

(8) Subject to the provisions of this Annex<br />

the Tribunal shall have full power to regulate<br />

its own procedure.<br />

(9) In dealing with the claims the Tribunal<br />

shall take into consideration :<br />

(a) any applicable rules of International<br />

Law ;<br />

(b) the general prineiples of justice<br />

and equity ;<br />

(c) the following circumstances<br />

(i) the date on which the land<br />

claimed was first occupied by the<br />

claimant or his predecessors in title;<br />

(ii) the date on which the claim<br />

was notified to the Government of the<br />

claimant ;<br />

(iii) the extent to which the<br />

claimant or his predecessors in title<br />

have developped and exploited the<br />

land claimed. In this connection the<br />

Tribunal shall take into account the<br />

extent to which the claimants may<br />

have been prevented from developing<br />

their undertakings by conditions or<br />

restrictions resulting from the war of<br />

1914-1919.<br />

(io) All the expenses of the Tribunal shall<br />

be divided among the claimants in such proportion<br />

as the Tribunal shall decide. If the amount<br />

of the sums paid in accordance with clause (6)<br />

is larger than the expenses of the Tribunal,<br />

the balance shall be returned to the parties<br />

whose claims have been recognised in such<br />

proportion as the Tribunal shall think fit.
