dans les faillites.<br />

150 Incendie volontaire.<br />

160 Destruction, d~gradation ou suppression<br />

volontaire et ill~gale d'un titre public ou priv6<br />

commise dans le but de causer du dommage hi<br />

autrui.<br />

170 Rec~lement des objets obtenus h l'aide<br />

d'un des crimes ou d~lits pr6vus par la prdsente<br />

convention.<br />

Sont comprises dans les qualifications prc6dentes,<br />

la complicit6 et la tentative, lorsqu'ees<br />

sont punies par les l6gislations de l'Etat requ&<br />

rant et de l'Etat requis.<br />

En mati~re correctionnelle, lorsqu'il s'agit<br />

d'une infraction prdvue par un des paragraphes<br />

ci-dessus, l'extradition aura lieu :<br />

I o Pour les condamn~s, contradictoirement<br />

ou par d~faut, lorsque la peine prononce sera<br />

au moins d'un an d'emprisonnement.<br />

20 Pour les pr6venus, lorsque le maximum<br />

de la peine applicable au fait incrimin6, sera,<br />

d'apr~s les lgislations de l'Etat requ~rant et<br />

de l'Etat requis, au moins de deux ans d'emprisonnement.<br />

Article 3.<br />

Dans aucun cas, les Parties contractantes ne<br />

seront tenues h se livrer leurs sujets.<br />

Si le pr~venu ou le condamn6 n'est pas sujet<br />

d'une des parties contractantes, le Gouvernement<br />

saisi de la demande d'extradition restera<br />

libre de donner h cette demande la suite qui<br />

lui paraitra convenable et de livrer le pr6venu<br />

pour ftre jug6, soit h son propre pays, soit au<br />

pays oh le crime ou le d~lit aura W commis.<br />

Article 4.<br />

L'extradition n'aura pas lieu<br />

io Si, depuis les faits imputes, depuis la<br />

poursuite ou la condamnation, la prescription<br />

de l'action on de la peine est acquise, d'aprs<br />

les lois du pays requis, an moment ott la demande<br />

est faite.<br />

(12) Perjury.<br />

(13) Corrupt practices, embezzlement committed<br />

by public officials ; corruption of public<br />

officials.<br />

(14) Fraudulent bankruptcy and fraud committed<br />

in bankruptcy.<br />

(15) Arson.<br />

(16) The wilful and unlawful destruction,<br />

falsification or suppression of public or private<br />

instruments with intent to injure another<br />

person.<br />

(17) Receiving objects obtained by means<br />

of one of the crimes or delicts referred to in<br />

the present Convention.<br />

The afore-going provisions apply also to<br />

complicity in and attempts to commit the<br />

crimes in question when such complicity or<br />

attempt is punishable by the laws both of the<br />

claimant State and the State on which the<br />

claim is made.<br />

In matters of summary jurisdiction, in the<br />

case of any offence enumerated in one of the<br />

above paragraphs, extradition shall take place :<br />

(I) For persons convicted after hearing,<br />

or by default, when the penalty inflicted<br />

amounts to at least one year's imprisonment.<br />

(2) For persons under summons, when the<br />

maximum penalty incurred by the offence<br />

amounts to at least two years' imprisonment<br />

by the laws both of the claimant State and the<br />

State on which the claim is made.<br />

Article 3.<br />

In no case shall the Contracting Parties be<br />

bound to deliver up their own subjects.<br />

If the accused or convicted person is not a<br />

subject of one of the Contracting Parties, the<br />

Government to whom the demand for extradition<br />

is addressed shall remain free to take such<br />

action thereon as it thinks fit, and to deliver<br />

up the accused for trial, either to his own<br />

country or to the country in which the crime<br />

or delict has been committed.<br />

Article 4.<br />

Extradition shall not take place<br />

(i) If at the time when the demand is<br />

made, exemption from prosecution or punishment<br />

has already been acquired by lapse of<br />

time since the date of the acts charged, the<br />

proceedings or the conviction, under the laws<br />

of the country on which the demand is made.
