i20 Faux serment.
130 Concussion, d~tournement, commis par
des fonctionnaires publics ; corruption de fonctionnaires
publics.
140 Banqueroute frauduleuse et fraudes commises
dans les faillites.
150 Incendie volontaire.
160 Destruction, d~gradation ou suppression
volontaire et ill~gale d'un titre public ou priv6
commise dans le but de causer du dommage hi
autrui.
170 Rec~lement des objets obtenus h l'aide
d'un des crimes ou d~lits pr6vus par la prdsente
convention.
Sont comprises dans les qualifications prc6dentes,
la complicit6 et la tentative, lorsqu'ees
sont punies par les l6gislations de l'Etat requ&
rant et de l'Etat requis.
En mati~re correctionnelle, lorsqu'il s'agit
d'une infraction prdvue par un des paragraphes
ci-dessus, l'extradition aura lieu :
I o Pour les condamn~s, contradictoirement
ou par d~faut, lorsque la peine prononce sera
au moins d'un an d'emprisonnement.
20 Pour les pr6venus, lorsque le maximum
de la peine applicable au fait incrimin6, sera,
d'apr~s les lgislations de l'Etat requ~rant et
de l'Etat requis, au moins de deux ans d'emprisonnement.
Article 3.
Dans aucun cas, les Parties contractantes ne
seront tenues h se livrer leurs sujets.
Si le pr~venu ou le condamn6 n'est pas sujet
d'une des parties contractantes, le Gouvernement
saisi de la demande d'extradition restera
libre de donner h cette demande la suite qui
lui paraitra convenable et de livrer le pr6venu
pour ftre jug6, soit h son propre pays, soit au
pays oh le crime ou le d~lit aura W commis.
Article 4.
L'extradition n'aura pas lieu
io Si, depuis les faits imputes, depuis la
poursuite ou la condamnation, la prescription
de l'action on de la peine est acquise, d'aprs
les lois du pays requis, an moment ott la demande
est faite.
(12) Perjury.
(13) Corrupt practices, embezzlement committed
by public officials ; corruption of public
officials.
(14) Fraudulent bankruptcy and fraud committed
in bankruptcy.
(15) Arson.
(16) The wilful and unlawful destruction,
falsification or suppression of public or private
instruments with intent to injure another
person.
(17) Receiving objects obtained by means
of one of the crimes or delicts referred to in
the present Convention.
The afore-going provisions apply also to
complicity in and attempts to commit the
crimes in question when such complicity or
attempt is punishable by the laws both of the
claimant State and the State on which the
claim is made.
In matters of summary jurisdiction, in the
case of any offence enumerated in one of the
above paragraphs, extradition shall take place :
(I) For persons convicted after hearing,
or by default, when the penalty inflicted
amounts to at least one year's imprisonment.
(2) For persons under summons, when the
maximum penalty incurred by the offence
amounts to at least two years' imprisonment
by the laws both of the claimant State and the
State on which the claim is made.
Article 3.
In no case shall the Contracting Parties be
bound to deliver up their own subjects.
If the accused or convicted person is not a
subject of one of the Contracting Parties, the
Government to whom the demand for extradition
is addressed shall remain free to take such
action thereon as it thinks fit, and to deliver
up the accused for trial, either to his own
country or to the country in which the crime
or delict has been committed.
Article 4.
Extradition shall not take place
(i) If at the time when the demand is
made, exemption from prosecution or punishment
has already been acquired by lapse of
time since the date of the acts charged, the
proceedings or the conviction, under the laws
of the country on which the demand is made.
